Holmes\u2019 story has been pervasive in the media over the last several years, resulting in a <a href=\"https:\/\/www.penguinrandomhouse.com\/books\/549478\/bad-blood-by-john-carreyrou\/9781524731656\/\">book<\/a>, a <a href=\"https:\/\/podcasts.apple.com\/us\/podcast\/the-dropout\/id1449500734\">podcast<\/a>, and an <a href=\"https:\/\/www.hbo.com\/documentaries\/the-inventor-out-for-blood-in-silicon-valley\">HBO documentary<\/a> being made about her and the Theranos scandal. Holmes\u2019 rise to fame, success recruiting big-name investors, and the innovative technology she proposed have given her almost celebrity status. Her trial is being followed by millions of people because of the broad implications it will have on start-up culture.<\/p>\n\n\n\n<p>The saga began in 2003 when Elizabeth Holmes dropped out of Stanford University at 19 years old. Although she originally wanted to practice medicine, <a href=\"https:\/\/www.businessinsider.com\/theranos-founder-ceo-elizabeth-holmes-life-story-bio-2018-4\">her fear of needles<\/a> prompted her to instead create Theranos Inc, a breakthrough medical-testing startup in Silicon Valley. Holmes adhered to a strict sleep and work schedule, wore black turtlenecks in a style reminiscent of Steve Jobs, and seemed to adopt a deeper voice when publicly speaking. Her revolutionary <a href=\"https:\/\/www.refinery29.com\/en-us\/2019\/03\/224904\/theranos-edison-machine-blood-test-technology-explained\">idea was ambitious but simple<\/a>: create a machine that can run more than 240 laboratory tests using only a single drop of blood.<\/p>\n\n\n\n<p>The machine, named the Edison machine after the famous inventor, was intended to perform laboratory tests known as immunoassays. These laboratory tests look for the presence of antibodies or antigens in the blood and can be used for things like drug or hormone levels, markers for cancer, and viruses. Theranos\u2019 <a href=\"https:\/\/web.archive.org\/web\/20160622193253\/https:\/www.theranos.com\/test-menu\">menu of tests<\/a> lists all of the tests they offered and the prices, which they tout as being \u201ca fraction of other labs\u201d to make \u201clab testing as accessible as possible.\u201d The\u2019 <a href=\"https:\/\/techcrunch.com\/2016\/08\/05\/unpacking-theranoss-magic-zika-detection-box\/\">device<\/a> was similar to other miniature testing machines, except that this tabletop machine could run more tests using blood from just one finger prick. The proposed technology worked much in the same way that a traditional lab test is performed: a small cartridge takes a sample, runs it through the machine, then sends the data to a centralized system to reveal the result.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" src=\"https:\/\/journals.law.unc.edu\\\/ncjolt\/wp-content\/uploads\/sites\/4\/2021\/10\/Callahan-Image-1024x661.png\" alt=\"\" class=\"wp-image-8457\" width=\"-321\" height=\"-207\" srcset=\"https:\/\/journals.law.unc.edu\/ncjolt\/wp-content\/uploads\/sites\/4\/2021\/10\/Callahan-Image-1024x661.png 1024w, https:\/\/journals.law.unc.edu\/ncjolt\/wp-content\/uploads\/sites\/4\/2021\/10\/Callahan-Image-300x194.png 300w, https:\/\/journals.law.unc.edu\/ncjolt\/wp-content\/uploads\/sites\/4\/2021\/10\/Callahan-Image.png 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n\n\n<p>Much of Theranos\u2019 reputation came from the list of high-profile names on the <a href=\"https:\/\/news.crunchbase.com\/news\/theranos-elizabeth-holmes-trial-investors-board\/\">board of directors<\/a>. The board included: former United States Secretaries of State, Henry Kissinger and George Schultz; Jim Mattis, retired Marine Corps general; Richard Kovacevich, former CEO of Wells Fargo; William Perry, former United States Secretary of Defense; and William Foege, former of the Centers for Disease Control and Prevention.<\/p>\n\n\n\n<p>Holmes also quickly <a href=\"https:\/\/www.wsj.com\/articles\/a-theranos-timeline-the-downfall-of-elizabeth-holmes-a-silicon-valley-superstar-11631576110\">garnered attention from investors<\/a>, and she raised almost $7 million in the first year. By 2014, Theranos was worth $9 billion and Elizabeth Holmes had a net worth of $4.5 billion, making her the youngest self-made female billionaire. Investors of Theranos included media tycoon <a href=\"https:\/\/www.cnn.com\/2013\/06\/10\/world\/rupert-murdoch-fast-facts\/index.html\">Rupert Murdoch<\/a>, venture capitalist <a href=\"https:\/\/timothydraper.com\/\">Tim Draper<\/a>, Oracle founder <a href=\"https:\/\/www.oracle.com\/corporate\/executives\/ellison\/\">Larry Ellison<\/a>, and a <a href=\"https:\/\/www.businesswire.com\/news\/home\/20130909005578\/en\/Theranos-Selects-Walgreens-as-a-Long-Term-Partner-Through-Which-to-Offer-Its-New-Clinical-Laboratory-Service\">partnership with Walgreens<\/a> pharmacies. Other companies, including Cleveland Clinic and Safeway, soon joined the list of partners.<\/p>\n\n\n\n<p>In fact, Theranos\u2019 suggested technology was groundbreaking in the field of medicine. Not only was the test minimally invasive, but it would also reduce health care costs. <a href=\"https:\/\/www.businesswire.com\/news\/home\/20150309005903\/en\/Theranos-Cleveland-Clinic-Announce-Strategic-Alliance-Improve\">The test was praised<\/a> as being well-suited for patients who require frequent blood draws because of the small blood sample size that reduced the need for large needles and multiple vials of blood required for most tests. Plus, Theranos offers test prices well below the price of Medicare reimbursement rates, leading to reduced healthcare costs for patients and providers.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>If this all sounds too good to be true, that\u2019s because it was. The technology didn\u2019t work. <a href=\"https:\/\/www.wsj.com\/articles\/theranos-has-struggled-with-blood-tests-1444881901\">In a shocking expos\u00e9 in 2015<\/a>, John Carreyrou uncovered the truth behind the innovative start-up and its enigmatic CEO and founder, Elizabeth Holmes. In fact, the machine couldn\u2019t perform the tests that it claimed, and Elizabeth Holmes knew that. The Edison device could only perform a handful of the hundreds of tests Theranos claimed, and most of the tests were actually performed on machines from outside companies like Siemens.<\/p>\n\n\n\n<p>Several former employees admit concerns that Theranos was violating Federal regulations, and even worse, that the test results were inaccurate. It turns out their concerns were valid. Several people claim they were affected by <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2018\/07\/05\/theranos-elizabeth-holmes-lawsuits-patients-harm-arizona\/742008002\/\">inaccurate Theranos test results<\/a>, including a woman who was misdiagnosed with a thyroid condition that prompted her to make doctors\u2019 appointments and begin taking medication she did not need. <a href=\"https:\/\/www.breitbart.com\/tech\/2021\/09\/13\/bbc-the-fantasy-science-of-theranos-empowered-silicon-valleys-promoters-and-scoundrels\/\">Another woman<\/a> was misdiagnosed with HIV, and yet another was incorrectly told she miscarried her baby.<\/p>\n\n\n\n<p>Very quickly, <a href=\"https:\/\/www.wsj.com\/articles\/blood-testing-firm-theranos-to-dissolve-1536115130\">Theranos imploded<\/a>. In the aftermath of being exposed as unreliable, investors began pulling out, federal regulators began to investigate the company\u2019s practices, and employees began speaking out. Theranos has been involved in multiple lawsuits against the company, and in 2018, Elizabeth Holmes was charged with civil-securities fraud and criminal fraud charges. The civil suit was settled, but Holmes\u2019 criminal trial, in which she is charged with <a href=\"https:\/\/abcnews.go.com\/Business\/theranos-founder-elizabeth-holmes-criminal-trial-begins\/story?id=79727093\">wire fraud and conspiracy to commit wire fraud<\/a>, finally began August 31 after multiple delays. Holmes is accused of defrauding investors, healthcare providers, and patients.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Elizabeth Holmes\u2019 trial and the demise of Theranos <a href=\"https:\/\/www.wired.com\/story\/theranos-indictments-expose-the-soul-of-silicon-valley\/\">highlight the problems<\/a> within Silicon Valley\u2019s start-up culture.<\/p><\/blockquote>\n\n\n\n<p>Elizabeth Holmes\u2019 trial and the demise of Theranos <a href=\"https:\/\/www.wired.com\/story\/theranos-indictments-expose-the-soul-of-silicon-valley\/\">highlight the problems<\/a> within Silicon Valley\u2019s start-up culture. The prosecution accuses Holmes of intending to deceive, while the defense claims she had good intentions and really believed her company was as good as she claimed. In order to be successful and attract investors, startup founders have to sell their companies. However, there is a \u201c<a href=\"https:\/\/www.protocol.com\/newsletters\/pipeline\/theranos-hype-fraud?rebelltitem=1#rebelltitem1\">thin line between hype and fraud<\/a>.\u201d This <a href=\"https:\/\/www.wired.com\/story\/theranos-elizabeth-holmes-trial-silicon-valley-is-watching\/\">\u201cfake it til you make it\u201d culture<\/a> is particularly prevalent with companies who patent their technology, making it <a href=\"https:\/\/slashdot.org\/story\/21\/09\/12\/2319241\/was-theranos-a-sign-of-larger-problems-in-silicon-valleys-startup-culture?utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+Slashdot%2Fslashdot+%28Slashdot%29\">proprietary property that cannot be revealed or reviewed<\/a>. Holmes will claim she was just trying her hardest to be successful.<\/p>\n\n\n\n<p>There have been talks about how this trial will affect startups and venture capital, particularly in the healthcare arena, starting with \u201ca higher standard of proof of business success.\u201d Future investors would be wise to do their due diligence and investigate the company they want to support. This is especially the case for healthcare startups, which is one of the <a href=\"https:\/\/www.beckershospitalreview.com\/healthcare-information-technology\/in-god-we-trust-all-others-bring-data-7-lessons-from-theranos-on-health-it-investing.html\">hardest areas to invest in<\/a> because of the importance of acquiring concrete data and scientific evidence that has been peer-reviewed and supported. Additionally, future <a href=\"https:\/\/www.entrepreneur.com\/article\/311036\">entrepreneurs can learn valuable lessons<\/a> from Theranos, including the importance of transparency, honestly, and taking responsibility.<\/p>\n\n\n\n<p><a href=\"https:\/\/isb.idaho.gov\/blog\/theranos-and-the-tale-of-the-disappearing-board-of-directors\/\">Future board members<\/a> should also take notes from Theranos\u2019 scandal, especially in ensuring that they understand the ins and outs of the operations of their company. Board members also should be aware of and ready to deal with compliance issues within their company before they become a problem. Developing a healthy company culture based on integrity can help board members recognize red flags sooner. <a href=\"https:\/\/www.forbes.com\/sites\/groupthink\/2016\/04\/27\/the-theranos-crisis-where-was-the-board\/?sh=3af2c8fdc58e\">Had Theranos\u2019 board of directors been more open and team-driven<\/a>, they may have been able to prevent such a disastrous result.<\/p>\n\n\n\n<p>Lastly, Holmes\u2019 trial has already had a negative impact on women CEOs, especially in the science and health tech industry. Since Theranos\u2019 demise, <a href=\"https:\/\/www.nytimes.com\/2021\/08\/24\/technology\/theranos-elizabeth-holmes.html\">there has been a pattern of female founders<\/a> having trouble receiving funding and getting compared to Holmes. Studies have shown that there is already a large <a href=\"https:\/\/journals.aom.org\/doi\/10.5465\/amj.2016.1215\">gender gap<\/a> in gaining funding for startups, and the Theranos scandal will only further widen it. Thus, <a href=\"https:\/\/www.marketplace.org\/shows\/marketplace-tech\/the-legacy-of-the-theranos-debacle-weighs-especially-heavy-on-women-in-biotech\/\">women CEOs<\/a> are indirectly affected by Elizabeth Holmes\u2019 actions.
