{"id":6025,"date":"2019-02-04T14:55:04","date_gmt":"2019-02-04T18:55:04","guid":{"rendered":"http:\/\/ncjolt.org\/?p=6025"},"modified":"2020-06-04T20:52:28","modified_gmt":"2020-06-04T20:52:28","slug":"is-2019-the-year-a-federal-carbon-tax-will-finally-pass","status":"publish","type":"post","link":"https:\/\/journals.law.unc.edu\/ncjolt\/blogs\/is-2019-the-year-a-federal-carbon-tax-will-finally-pass\/","title":{"rendered":"Is 2019 The Year a Federal Carbon Tax Will Finally Pass?"},"content":{"rendered":"\n<p>In 2018, carbon dioxide emissions in the United States rose <a href=\"https:\/\/www.nytimes.com\/2019\/01\/08\/climate\/greenhouse-gas-emissions-increase.html\">an\nestimated 3.4 percent<\/a> compared to previous years. Despite coal plants\nretiring last year, greenhouse gas emissions from \u201cfactories, planes, and\ntrucks soared.\u201d As climate change impacts continue to be realized both\ninternationally and domestically, U.S. legislators are seeking innovative\nsolutions to mitigate and account for the impacts from greenhouse gases and\nother harmful emissions. <\/p>\n\n\n<p>Legislators at the state and federal level\ncontinue to propose policies to try to combat this growing problem. California\nlegislators were successful in enacting the <a href=\"https:\/\/www.arb.ca.gov\/cc\/capandtrade\/capandtrade.htm\">California Cap and\nTrade Program<\/a>, which began in 2012. Similarly, the <a href=\"https:\/\/www.rggi.org\/\">Regional Greenhouse Gas Initiative<\/a> (\u201cRGGI\u201d)\ncomprised of Connecticut, Delaware, Maine, Massachusetts, New Hampshire, New\nYork, Rhode Island, and Vermont is a market-based program to reduce greenhouse\ngas emissions, which began in 2009. At a federal level, legislators up to this\npoint have been unsuccessful in passing a carbon pricing program.<\/p>\n\n\n<p>On January 24, 2019, Representative Ted Deutch of Florida, along with six other Representatives (five Democrats and a Republican) reintroduced a bipartisan bill in the U.S. House of Representatives to enact a carbon tax. <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/763\/all-info?r=1\">H.R. 763<\/a>\u2019s goal is \u201cto create a Carbon Dividend Trust Fund for the American people in order to encourage market-driven innovation of clean energy technologies and market efficiencies which will reduce harmful pollution and leave a healthier, more stable, and more prosperous nation for future generations.\u201d The Bill has been referred to the Committee on Ways and Means, the Committee on Energy and Commerce, and the Committee on Foreign Affairs.<\/p>\n\n\n<blockquote class=\"wp-block-quote\"><p>On January 24, 2019, Representative Ted Deutch of Florida, along with six other Representatives (five Democrats and a Republican) reintroduced a bipartisan bill in the U.S. House of Representatives to enact a carbon tax.<\/p><\/blockquote>\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The proposed\nBill is similar to H.R. 7173, The Energy Innovation and Carbon Dividend Act of\n2018, that was introduced in November 2018, but remained <a href=\"https:\/\/www.law360.com\/tax-authority\/articles\/1121733\/house-members-reintroduce-bipartisan-carbon-tax-bill\">stuck\nin Congress<\/a> during last session. <a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/7173\">H.R. 7173<\/a> proposed a $15\nper metric ton of emissions on producers or importers of fuels that are used to\nemit greenhouse gases into the atmosphere. H.R. 763 proposes to begin at a\nsimilar $15 per metric ton tax, but then to raise <a href=\"https:\/\/thehill.com\/opinion\/energy-environment\/427336-a-solution-to-climate-change-that-democrats-and-republicans-can\">the\ncarbon tax<\/a> to \u201c$100 per metric ton within a decade, making it one of the\nmost ambitious carbon-pricing policies in the world.\u201d H.R. 763 also differs\nfrom H.R. 7173 by updating the emission targets. As proposed in H.R. 7173\nagricultural fuels would remain exempt in H.R. 763.<\/p>\n\n\n<p>The<a href=\"https:\/\/thehill.com\/opinion\/energy-environment\/427336-a-solution-to-climate-change-that-democrats-and-republicans-can\"> proceeds generated<\/a> from H.R. 763 are proposed to be directed to individual households that would have higher energy costs due to the carbon tax. The goal of the bill is to ensure those who may be most impacted by higher electric bills or gasoline prices will be protected. Not only will vulnerable populations be protected financially, but also H.R. 763 is estimated to reduce deaths related to air pollution by 114,000 per year. Prior to the November 2018 Energy Innovation and Carbon Dividend Tax Act, it was a decade since a <a href=\"prior%20to%20the%20November%202018%20Energy%20Innovation%20and%20Carbon%20Dividend%20Tax.\">bipartisan carbon pricing program<\/a> was introduced. The reintroduced H.R. 763 bill only has one Republication co-sponsor. With the current Republican Senate and the Trump Administration\u2019s opposition to climate change related programs, it is unclear what action will be taken on the proposed H.R. 763. <a href=\"https:\/\/www.law360.com\/tax-authority\/articles\/1121733\/house-members-reintroduce-bipartisan-carbon-tax-bill\">Other concerns<\/a> with H.R. 763 are with regards to the administrability.
