These days, the <\/span><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">VELCRO\u00ae Brand&nbsp;means business. Just a year ago the company released a<\/span><span style=\"margin: 0px;color: black;font-family: 'Times',serif\"> <a href=\"https:\/\/www.velcro.com\/about-us\/dontsayvelcro\/\">website<\/a> and <a href=\"https:\/\/www.youtube.com\/watch?v=rRi8LptvFZY\">colorful advertisement<\/a> but has also continued to educate the general public on the consequential damages of \u201cgenericide.\u201d<\/span><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\"> While this might be a ridiculous avenue, it\u2019s clearly working to grab the attention of consumers like myself who are contributing to the destruction of this trademark. <\/span><br \/>\n<span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">The fight against \u201cgenericide\u201d sounds like an organization going after a disease, which isn\u2019t far off from the problem at hand. This <a href=\"https:\/\/www.thoughtco.com\/what-is-malapropism-1691368\">malapropism<\/a> created by the success of the company could lead to the ironic death of the trademark. For example, these other successful companies have lost their trademark and may not be recognized because their products are common in today\u2019s vocabulary: <a href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_generic_and_genericized_trademarks\">aspirin, escalator, laundromat, and thermos.<\/a> \u201c<a href=\"https:\/\/www.thoughtco.com\/genericide-nouns-term-1690891\">Genericide\u201d<\/a> is a legal term that captures the process of a protectible trademark transitioning into a common noun through popular usage. Moreover, it turns the trademark generic (and not protectable) by coming to stand for the product itself and confusing consumers as to the source.<\/span><\/p>\n<blockquote><p><span style=\"margin: 0px;font-family: 'Times New Roman',serif;font-size: 12pt\"><a href=\"https:\/\/www.legalzoom.com\/articles\/how-to-protect-against-trademark-infringement\">\u201cTrademarking does not protect the right to reproduce a logo. A Trademark protects [the] investment in a relationship with [the] customers.\u201d<\/a><\/span><\/p><\/blockquote>\n<p><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">When a company goes to trademark their product, it\u2019s important that they provide a mark that is less descriptive of the product and more arbitrary. A descriptive trademark that describes the product will have to acquire distinctiveness through what is known in the business as \u201csecondary meaning.\u201d This hurdle requires consumers to recognize that the trademark links the product to a source, which requires time and money to advertise the products for a period long enough to gain consumer recognition. However, once a trademark is granted it is up to the company through their lawyers, advertisements, and employees to keep their trademark from becoming generic and thus at loss. <\/span><br \/>\n<span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">&nbsp;In the case of VELCRO\u00ae, the company seeks to protect its 300 trademarked products from becoming generic as consumers tend to misuse the word \u201cVelcro\u201d as both a verb and in description of various products not made by the company. Instead a VELCRO\u00ae product is called a \u201cHook and Loop.\u201d An <a href=\"https:\/\/www.velcro.com\/about-us\/dontsayvelcro\/\">example<\/a> from their website demonstrates the ease of this mistake: <\/span><\/p>\n<ul>\n<li><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">Incorrect: He helped his son Velcro his shoes.<\/span><\/li>\n<li><span style=\"margin: 0px;color: black;font-family: 'Times',serif\">Correct: He helped his son fasten his shoes.<\/span><\/li>\n<\/ul>\n<p><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">The <a href=\"https:\/\/www.inta.org\/INTABulletin\/Pages\/PracticalTipsonAvoidingGenericide.aspx\">legal standard<\/a> of whether a trademark is generic follows a two-part inquiry: <\/span><br \/>\n<span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">\u201cFirst, what is the genus of the goods or services at issue? Second, is the term sought to be registered . . . understood by the relevant public primarily to refer to that genus of goods or services?\u201d&nbsp;For companies, this means absorbing the expensive cost of protecting against trademark infringement and advertisements to help consumers connect the product to the source.<\/span><br \/>\n<span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">&nbsp;<\/span><span style=\"margin: 0px;color: black;font-family: 'Times',serif\"><a href=\"https:\/\/www.legalzoom.com\/articles\/how-to-protect-against-trademark-infringement\">\u201cTrademarking does not protect the right to reproduce a logo. A Trademark protects [the] investment in a relationship with [the] customers.\u201d<\/a><\/span><br \/>\n<span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif\">&nbsp;<\/span><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif;font-size: 12pt\">Recently VELCRO has released a follow-up video, <\/span><b><u><span style=\"margin: 0px;color: black;font-family: 'Times',serif;font-size: 12pt\"><a href=\"https:\/\/www.youtube.com\/watch?v=ZLWMQLMiTPk\">\u201cThank You For Your Feedback \u2014 Don\u2019t Say Velcro.\u201d<\/a><\/span><\/u><\/b><span style=\"margin: 0px;color: black;font-family: 'Times',serif;font-size: 12pt\"> In addition, <\/span><span style=\"background: white;margin: 0px;color: black;font-family: 'Times',serif;font-size: 12pt\">VELCRO\u2019s Senior Counsel and the Director of Global Brand have <a href=\"https:\/\/www.law.com\/corpcounsel\/2018\/06\/06\/velcro-fights-trademark-misuse-with-a-second-music-video-starring-in-house-lawyers\/\">commented<\/a> on the continued success by a decrease in the trademark\u2019s misuse and responses via social media that signal consumers have picked up on the brand\u2019s \u201chook and loop\u201d fasteners. <a href=\"https:\/\/www.law.com\/corpcounsel\/2018\/06\/06\/velcro-fights-trademark-misuse-with-a-second-music-video-starring-in-house-lawyers\/\">Other companies<\/a> have also reached out in hopes of using the videos for their own company training.
