Not fair to public!\u201d<br \/>\nSpecifically, Trump <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/918112884630093825\">tweeted<\/a> \u201cWith all of the Fake News coming out of NBC and the Networks, at what point is it appropriate to challenge their License? Bad for country!\u201d<br \/>\nIn response to Trump\u2019s plentiful <a href=\"https:\/\/twitter.com\/realDonaldTrump\">tweets<\/a> this month regarding the Fake News and calling on the revocation of their licenses, and various Democrats within Congress requesting the Federal Communications Commission (FCC) to comment, the FCC Chairman, Ajit Pai, <a href=\"https:\/\/www.washingtonpost.com\/news\/the-switch\/wp\/2017\/10\/17\/trumps-fcc-chair-has-finally-addressed-the-nbc-license-issue\/?utm_term=.83fc48e1b260\">stated<\/a>, \u201cI believe in the First Amendment. The FCC, under my leadership, will stand for the First Amendment. Under the law, the FCC does not have the authority to revoke licenses of a broadcast station based on the content of a particular newscast.\u201d<br \/>\nThe First Amendment, as <a href=\"http:\/\/nypost.com\/2017\/10\/15\/nbcs-license-wont-be-revoked-over-trump-fcc-commissioner\/\">interpreted<\/a> by the Supreme Court, is \u201ca profound national commitment to having a robust, uninhibited and wide open debate,\u201d which can allow critical rhetoric against both samaritans and public officials alike. Furthermore, Jessica Rosenworcel, one of the FCC commissioners appointed by Trump, <a href=\"http:\/\/nypost.com\/2017\/10\/15\/nbcs-license-wont-be-revoked-over-trump-fcc-commissioner\/\">highlights<\/a> that \u201c[i]t\u2019s essential that the FCC in all that it does is careful to abide by the First Amendment when it engages in any kinds of policies engaging broadcast licensees.\u201d<br \/>\nConsequently, the FCC <a href=\"http:\/\/www.washingtonexaminer.com\/trumps-threats-to-revoke-broadcast-licenses-put-fcc-in-a-catch-22\/article\/2638060\">rarely<\/a> revokes a broadcasting licenses. This rarity arose when \u201ca woman died from water intoxication after competing in a contest called \u2018Hold Your Wee for a Wii.\u2019\u201d The FCC terminated that California radio station\u2019s license, however there are not \u201cmany contemporary historical examples, but the best example is killing someone.\u201d<br \/>\n<a href=\"http:\/\/nypost.com\/2017\/10\/15\/nbcs-license-wont-be-revoked-over-trump-fcc-commissioner\/\">Accordingly<\/a>, in the 1970s former President Nixon suggested revoking the Washington Post\u2019s license for its coverage of Watergate was ultimately unsuccessful. While these licenses renew every eight years and the FCC can reject renewal if broadcast engaging in <a href=\"https:\/\/www.washingtonpost.com\/news\/post-politics\/wp\/2017\/10\/13\/can-president-trump-really-revoke-broadcast-licenses\/?utm_term=.5a3a05bb6336\">illegal<\/a> activity, that determination is solely left to the FCC. Moreover, the FCC <a href=\"https:\/\/www.washingtonpost.com\/news\/the-switch\/wp\/2017\/10\/17\/trumps-fcc-chair-has-finally-addressed-the-nbc-license-issue\/?utm_term=.83fc48e1b260\">seldom<\/a> proactively revokes a license, much less on the basis of supposedly objectionable content.<br \/>\nWhile Pai effectively and objectively set the record that the President does not have the power to revoke broadcasting licenses, there are further legal technicalities overlooked. The <a href=\"https:\/\/soundcloud.com\/washington-post\/is-it-within-a-presidents-power-to-strip-broadcast-licenses\">FCC<\/a> is an independent agency, which means it is not a part of the executive branch and domain of the president. Additionally, while the FCC sets broadcast rules, FCC does not license <a href=\"https:\/\/www.fcc.gov\/sites\/default\/files\/public-and-broadcasting.pdf\">networks<\/a>. The FCC licenses individual broadcast stations; the owner of the stations privately contract with networks.<br \/>\nWith respect to administrative law concerns, the extent to which a president can inject his\/her power within independent agencies is through the nomination of the chairman from sitting commissioners, which is then subject to Senate confirmation. Therefore, the <a href=\"http:\/\/www.washingtonexaminer.com\/trumps-threats-to-revoke-broadcast-licenses-put-fcc-in-a-catch-22\/article\/2638060\">threat<\/a> that the FCC faces, specifically Pai, is that Trump has the power to keep Pai as chairman or demote him come 2019.<br \/>\nAll five FCC commissioners are <a href=\"https:\/\/energycommerce.house.gov\/news\/press-release\/next-week-subcommtech-hold-oversight-hearing-fcc-commissioners\/\">expected<\/a> to attend a hearing October 25<sup>th<\/sup>, by the Subcommittee on Communications and Technology. In considering the oversight of the FCC; the <a href=\"https:\/\/energycommerce.house.gov\/news\/press-release\/next-week-subcommtech-hold-oversight-hearing-fcc-commissioners\/\">Subcommittee\u2019s<\/a> commitment to an accountable FCC through \u201c\u2019. . . eliminating onerous regulations, reforming programs, and creating the right conditions to help expand broadband access across America\u2019;\u201d and whether the FCC might prevent a station\u2019s license renewal due to political pressures, relevant parties should consider the President\u2019s own <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/920474831749025795\">words<\/a>,<\/p>\n<blockquote><p>\u201cThe most important truth our FOUNDERS understood was: FREEDOM is NOT a gift from Govt.
