{"id":5378,"date":"2017-10-30T20:58:08","date_gmt":"2017-10-31T00:58:08","guid":{"rendered":"http:\/\/ncjolt.org\/?p=5378"},"modified":"2020-06-04T20:52:51","modified_gmt":"2020-06-04T20:52:51","slug":"fercs-response-proposed-grid-resiliency-pricing-rule-will-process-continue-moving-rapidly","status":"publish","type":"post","link":"https:\/\/journals.law.unc.edu\/ncjolt\/blogs\/fercs-response-proposed-grid-resiliency-pricing-rule-will-process-continue-moving-rapidly\/","title":{"rendered":"FERC\u2019s Response to DOE\u2019s Proposed Grid Resiliency Pricing Rule: Will the Process Continue Moving So Rapidly?"},"content":{"rendered":"<p>September 28<sup>th<\/sup>, the Department of Energy (DOE) <a href=\"http:\/\/journals.law.unc.edu\\\/ncjolt\/dept-energy-proposes-new-rule-support-baseload-resources-will-ferc-respond-good-policy\/\">issued<\/a> a Notice of Proposed Rulemaking (NOPR) for a <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2017-10-10\/pdf\/2017-21396.pdf\">\u201cGrid Resiliency Pricing Rule.\u201d<\/a> This rule directs the Federal Energy Regulatory Commission (FERC) to attribute greater value to \u201cbaseload\u201d resources like coal and nuclear by allowing them to recover full cost of plant service. These resources are touted to be more reliable and resilient than intermittent renewables, like wind and solar, or natural gas facilities, which cannot easily store fuel on site. Aside from the controversy surrounding what generation sources are <a href=\"http:\/\/rhg.com\/notes\/doe-nopr-ferc-comments\">truly<\/a> <a href=\"https:\/\/www.platts.com\/latest-news\/electric-power\/houston\/harveys-rain-caused-coal-to-gas-switching-nrg-21081527\">\u201creliable\u201d<\/a> or <a href=\"https:\/\/rmi.org\/news\/fuel-hand-make-coal-nuclear-power-plants-valuable\/\">\u201cresilient\u201d<\/a>, whether the conversation around grid reliability is even <a href=\"http:\/\/energyinnovation.org\/wp-content\/uploads\/2017\/10\/A-Roadmap-For-Finding-Flexibility-In-Wholesale-Power-Markets.pdf\">properly focused<\/a>, or the <a href=\"http:\/\/www.naturalgasintel.com\/articles\/111976-does-grid-resiliency-nopr-target-of-sharp-criticism-at-house-subcommittee-hearing\">potential effects on competitive electricity markets<\/a>, DOE\u2019s vague demand for prompt FERC action and FERC\u2019s developing response gives cause for interest.<br \/>\nDOE demanded that FERC respond and take action within 60 days and to act \u201cexpeditiously.\u201d FERC has since expedited the process\u2014initial comments are due today, October 23<sup>rd<\/sup>. Intervening parties will be responding to a series of impressively <a href=\"https:\/\/www.ferc.gov\/media\/headlines\/2017\/2017-3\/10-04-17.pdf\">broad questions<\/a> from FERC, ranging from \u201cWhat is resilience?\u201d to \u201cHow should [organized markets] allocate the cost of the proposed rule to market participants?\u201d<\/p>\n<blockquote><p>Chairman Neil Chatterjee has publicly announced that the proposed Grid Resiliency Pricing Rule will be a <a href=\"http:\/\/www.utilitydive.com\/news\/chatterjee-sets-pipelines-grid-resilience-as-priorities-for-ferc-chairmans\/507567\/\">top priority<\/a> for FERC this upcoming year, but Commissioners Robert <a href=\"http:\/\/www.snl.com\/web\/client?auth=inherit#news\/article?id=42186421&amp;cdid=A-42186421-12849\">Powelson<\/a> and Cheryl <a href=\"https:\/\/twitter.com\/CLaFleurFERC\/status\/915698742849875973\">LaFleur<\/a> have expressed doubt.<\/p><\/blockquote>\n<p>Among the biggest reasons for doubt include not only DOE\u2019s rushed timeline but also the degree of vagueness in DOE\u2019s NOPR. This is evidenced by FERC\u2019s overbroad questions for commenters, and Commissioner LaFleur <a href=\"http:\/\/www.utilitydive.com\/news\/lafleur-doe-nopr-likely-not-detailed-enough-to-form-final-rule\/507488\/\">recently shared<\/a> that FERC is \u201cgetting ahead of [itself]\u201d because \u201c[i]f you were to try to put that [NOPR] into law . . . it would [need to] be considerably more detailed.\u201d The DOE timeline is as follows: a 45-day notice and comment period, followed by a 15-day period by which FERC must \u201ccomplete final action on the rule,\u201d and finally a 15-day period by which organized markets must submit compliance filings. This turnaround is absolutely untenable, and FERC <a href=\"https:\/\/elibrary.ferc.gov\/idmws\/common\/OpenNat.asp?fileID=14708557\">denied<\/a> industry associations\u2019 (ranging from American Wind Energy Association to the American Petroleum Institute) request for an extension on the notice and comment period. This indicates that, for now at least, FERC intends to follow DOE\u2019s tight timeline and move forward with the proposed Grid Resiliency Pricing Rule.<br \/>\nWith <a href=\"https:\/\/powersuite.aee.net\/dockets\/ferc-rm18-1-000?docket_search_id=298967\">over 200 received comments<\/a> and the NOPR\u2019s initial vagueness, <a href=\"http:\/\/www.utilitydive.com\/news\/former-ferc-heads-doe-nopr-would-fundamentally-distort-power-markets\/507627\/\">broad criticism<\/a> of the NOPR, a new FERC Chairman undergoing the <a href=\"https:\/\/www.energy.senate.gov\/public\/index.cfm\/hearings-and-business-meetings?ID=1F2B5ABA-A677-48D1-8218-44C348A26B5D\">nomination process<\/a>, and even Chairman Chatterjee\u2019s tempered approach in highlighting FERC\u2019s independence and reassurance that FERC has many tools at its disposal to \u201cact\u201d, FERC is likely to move forward thoughtfully and with great care. As Chairman Chatterjee recently <a href=\"http:\/\/thehill.com\/policy\/energy-environment\/355320-energy-commission-head-sympathetic-to-parts-of-proposal-to-prop-up\">stated<\/a>, &#8220;We\u2019ve invested nearly two decades and billions upon billions of dollars in our existing market structure, and I don\u2019t want to do anything to disrupt that market structure.\u201d<br \/>\nIt is important that FERC keeps this sentiment in the front of its mind as it moves forward. Benefits to the grid like reliability, resilience, and flexibility should all be properly valued within FERC-jurisdictional markets. However, FERC must engage in a deliberate, honest, and detailed inquiry into these issues if it wants to ensure rates are truly just and reasonable and price signals maintain competitive markets.
