{"id":4786,"date":"2016-11-01T16:02:43","date_gmt":"2016-11-01T20:02:43","guid":{"rendered":"http:\/\/ncjolt.org\/?p=4786"},"modified":"2020-06-04T20:52:58","modified_gmt":"2020-06-04T20:52:58","slug":"new-york-airbnb-hosts-not-pass-go-also-pay-7500-fines","status":"publish","type":"post","link":"https:\/\/journals.law.unc.edu\/ncjolt\/blogs\/new-york-airbnb-hosts-not-pass-go-also-pay-7500-fines\/","title":{"rendered":"New York Airbnb Hosts: Do Not Pass Go, And Also, Pay $7,500 in Fines"},"content":{"rendered":"<p>Airbnb filed a federal lawsuit on Friday, October 21, 2016 after New York Governor Andrew Cuomo signed a bill that would fine Airbnb hosts up to $7,500 for posting illegal short-term rentals on the popular website.<\/p>\n<blockquote><p>Airbnb contends the law violates free speech and due process, and additionally violates their rights under the Communications Decency Act,<\/p><\/blockquote>\n<p>\u201c<span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.nytimes.com\/2016\/10\/22\/technology\/new-york-passes-law-airbnb.html\">a federal law<\/a><\/span> that says websites cannot be held accountable for content published by their users.\u201d<br \/>\nProponents of the bill, which <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.pbs.org\/newshour\/rundown\/airbnb-new-york-illegal-lawsuit\/\">legislators approved 110-24<\/a><\/span> in June 2016, say the fines are an effort to keep housing affordable. Considering New York City is already one of the most expensive places on the planet to rent an apartment the size of a closet, surely Airbnb and Airbnb\u2019ers alike can sympathize. Moreover, <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.slate.com\/blogs\/moneybox\/2016\/10\/24\/some_new_york_airbnb_hosts_may_be_fined_under_a_new_law.html\">the bill doesn\u2019t change<\/a><\/span> what is and isn\u2019t legal regarding rentals, so this isn\u2019t technically imposing anything new on Airbnb, which has been criticized for considering itself <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.nydailynews.com\/opinion\/james-mckee-airbnb-disease-cure-article-1.2838950\">above the law<\/a><\/span>. Advocates of the bill hope the new fines will give teeth to existing law since many, if not most, Airbnb hosts in New York have been violating the law with impunity for a while now. The first violation will cost a host $1,000, the second violation will cost $5,000, and the third violation will cost $7,500. What <em>is<\/em> new is that the law makes it illegal to advertise an illegal rental. This last part is what Airbnb believes violates due process and their rights under the Communications Decency Act.<br \/>\n&nbsp;<br \/>\nThe current New York<span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/ny.curbed.com\/2013\/3\/25\/10260752\/an-introduction-to-new-yorks-short-term-rental-laws\"> housing law<\/a><\/span> has existed since 2011 and prohibits renting permanent multiple dwelling apartments for periods shorter than 30 days, unless the owner who is renting out the apartment is also occupying the apartment at the same time.<\/p>\n<blockquote><p>A <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.ag.ny.gov\/pdfs\/Airbnb%20report.pdf\">report<\/a><\/span> by the New York Attorney General found that between 2010 and 2014, 72% of short-term Airbnb rental units in New York violated housing law.<\/p><\/blockquote>\n<p>Critics of Airbnb like the current housing law because it makes it illegal to basically turn apartments into hotels, which drives up the cost of housing. For example, a report by the Housing Conservation Coordinators and MFY Legal Services found that the average price of rentals in the top 20 Airbnb neighborhoods rose by 10%, suggesting a direct correlation between the availability of Airbnb rentals and increasing rental costs. Cost is not the only factor\u2014permanent stable housing is also incredibly scarce in the city. According to the report, 8,000 housing units were lost to Airbnb, which reduced the availability of affordable housing by 10%. Advocates also claim the bill protects residents from noisy and obnoxious Airbnb\u2019ers in these black market \u201c<span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.nydailynews.com\/opinion\/james-mckee-airbnb-disease-cure-article-1.2838950\">de-facto hotels<\/a><\/span>.\u201d<br \/>\nNew York is Airbnb\u2019s largest market, so the company\u2019s revenue could take a serious hit if they\u2019re unable to overturn the law. In its complaint, Airbnb stated that in order to comply with this new law, \u201cAirbnb would be required to screen and review every listing a host seeks to publish.\u201d The company also stated the law &#8220;creates the incorrect perception that Airbnb\u2019s own activities are unlawful&#8221; and \u201cwill lead to the sort of reputational injury and loss of goodwill that irreparably harms a business.&#8221;<br \/>\nAirbnb\u2019s central argument, that it will be illegally penalized for content posted by users, is essentially the same argument they\u2019re using to fight <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/venturebeat.com\/2016\/10\/22\/latest-new-york-and-san-francisco-lawsuits-highlight-global-risks-for-airbnb\/\">similar legislation in San Francisco<\/a><\/span>, which happens to be the company\u2019s home. Sites like eBay and Amazon have cited the same law to protect themselves against liability from illegal transactions between users, but the argument might not be a winner for Airbnb this time. The U.S. District judge presiding over the San Francisco case said earlier this month that he \u201cwasn\u2019t \u2018seeing the link\u2019 between free speech protections and San Francisco\u2019s short-term rental regulations.\u201d<br \/>\nPrior to Cuomo\u2019s signing, Airbnb doled out a list of<span style=\"color: #0000ff\"> <a style=\"color: #0000ff\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2016-10-19\/airbnb-seeks-to-curry-favor-with-cuomo-ahead-of-n-y-legislation\">alternative measures<\/a><\/span> (like preventing hosts in New York from listing more than one apartment), which many viewed as an eleventh-hour-hail-mary pass that was too little, and too late.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Airbnb filed a federal lawsuit on Friday, October 21, 2016 after New York Governor Andrew Cuomo signed a bill that would fine Airbnb hosts up to $7,500 for posting illegal short-term rentals on the popular website.
