Minimizing Legal Conflicts with Geo-fencing."},"content":{"rendered":"<p>With the release of \u201cPokemon Go\u201d in July 2016, the real world was invaded with virtual monsters. Armed with GPS-enabled smartphones, players, called \u201ctrainers,\u201d explore the real world to locate and catch these virtual monsters, or \u201cPokemon.\u201d The game also designates real world landmarks as virtual \u201cPokestops\u201d and \u201cGyms\u201d were trainers can resupply on in-game necessities and battle their Pokemon for control of the area. However, the drive to \u201ccatch \u2018em all\u201d is <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.businessinsider.com\/r-get-off-my-lawn-pokemon-go-tests-global-property-laws-2016-9\">testing global property laws<\/a><\/span> when placement of these virtual structures and monsters are unwelcome. Pokestop and Gym placement on private property has led to at least <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/www.stinson.com\/Resources\/Articles\/2016_Articles\/Gotta_Catch__Em_All\u2122_-_Pok__233;mon\u2122_Go_Gives_Rise_to_New_Class_Action_Suits.aspx\">three class action lawsuits in the U.S. and one in Canada<\/a><\/span>. Other Pokestop and Gyms have raised controversy such as placement in <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.washingtontimes.com\/news\/2016\/oct\/5\/inside-the-ring-pokemon-go-security-worries\/\">the Pentagon<\/a><\/span>, <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/www.washingtonpost.com\/news\/the-switch\/wp\/2016\/07\/12\/holocaust-museum-to-visitors-please-stop-catching-pokemon-here\/\">the U.S. Holocaust Memorial<\/a><\/span>, and\u2026 <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.bangkokpost.com\/news\/asean\/1103992\/singapore-protects-nature-reserves-from-pokemon-go\">nature preserves<\/a><\/span>?<br \/>\nAs many State and National Parks seek to<span style=\"color: #0000ff\"> <a style=\"color: #0000ff\" href=\"https:\/\/cronkitenews.azpbs.org\/2016\/08\/17\/park-service-push-centennial-visitors-worries-environmental-groups\/\">boost visitation<\/a><\/span> and <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.wsj.com\/articles\/pokemon-go-gives-boost-to-national-parks-1468447301\">connect with the younger, technophile generation<\/a><\/span>, Pokemon Go seems like the perfect panacea. The game has been wildly successful in getting players outdoors and moving\u2014increasing U.S. activity levels by <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/www.technologyreview.com\/s\/602706\/pokemon-go-increased-us-activity-levels-by-144-billion-steps-in-just-30-days\/\">144 billion steps in just 30 days<\/a><\/span>\u2014and this has indeed translated to <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.wsj.com\/articles\/pokemon-go-gives-boost-to-national-parks-1468447301\">a boost to National Parks<\/a><\/span>. However, the game is also causing problems for Parks. Three Pok\u00e9stops in <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.straitstimes.com\/singapore\/remove-pokestops-from-nature-reserves-nparks\">Singapore\u2019s nature reserves<\/a><\/span> are located in sensitive, off-limit forest,<\/p>\n<blockquote><p>leading players off-trail where they may trample vegetation, disturb wildlife, and otherwise damage the environment.<\/p><\/blockquote>\n<p>Pokemon in the <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/www.theguardian.com\/technology\/2016\/sep\/29\/niantic-labs-dutch-pokemon-go\">Netherland\u2019s protected beaches of Kijkduin<\/a><\/span>, named the Pokemon capital of the country, has attracted thousands of players, potentially damaging the dunes.<br \/>\nWhile Niantic, the game maker, has instituted a <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/support.pokemongo.nianticlabs.com\/hc\/en-us\/articles\/221968408-Reporting-Pok\u00e9Stop-or-Gym-Issues\">request system for removing a Pok\u00e9stop or Gym<\/a><\/span> via their website, the Singapore National Parks Board\u2019s appeals have gone <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.straitstimes.com\/singapore\/remove-pokestops-from-nature-reserves-nparks\">unanswered since August<\/a><\/span>. Further, Pokestops and Gyms are only half the problem, and no such request system exists for Pokemon spawning. Authorities in the Netherlands\u2019 attempts to contact Niantic since mid-August were also unsuccessful\u2026 <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/www.theguardian.com\/technology\/2016\/sep\/29\/niantic-labs-dutch-pokemon-go\">until they filed suit.<\/a><\/span> The case was set to be heard on October 11<sup>th<\/sup>, when <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.gmanetwork.com\/news\/story\/584503\/lifestyle\/travel\/pokemon-go-vows-to-remove-monsters-from-dutch-dunes\">Niantic withdrew all Pokemon from the area<\/a><\/span>.<br \/>\nAuthorities in the Netherlands suggested <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/gamerant.com\/pokemon-go-netherlands-court-112\/\">toning down spawn rates, or turning off Pokemon spawning between 11:00 pm and 7:00 am<\/a><\/span>. While Niantic has integrated fixes for other legal problems, such as <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.itechpost.com\/articles\/41890\/20161016\/pokemon-go-update-niantic-remove-spawns-and-sightings-when-driving-players-outraged.htm\">turning off spawning when travelling above 30 mph<\/a><\/span> to limit playing while driving, and time sensitive play would likely also cut down on <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/technology.inquirer.net\/52724\/watch-pokemon-go-player-mugged-while-livestreaming-ny\">criminal acts against players<\/a><\/span>, one possible solution to location-based Pokemon-spawning problems seems obvious: Geofencing.<br \/>\nA geofence is a virtual barrier within the real world and has an almost <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/whatis.techtarget.com\/definition\/geofencing\">limitless number of uses<\/a><\/span>. The mobile app <a href=\"http:\/\/time.com\/3694578\/you-asked-what-is-yik-yak\/\"><span style=\"color: #0000ff\">Yik Yak has already instituted geofences around schools<\/span><\/a> after bullies took advantage of the app\u2019s anonymous nature. Geofencing off-limits areas of National Parks and Preserves to Pokemon spawning may be a good start, but geofencing could also be used to turn off Pokemon spawning when a player breaks from an approved trail, or perhaps even reduce Pokemon spawn rate when too many players enter an area. However, any of these strategies would have to be implemented on Niantic.<br \/>\nIt\u2019s unclear how a suit like the one in the Netherlands would be settled anyways. The current state of the law is inadequate to address the intersection between virtual reality and real property, and it is unclear what rights landowners have to their property in the virtual realm.
