{"id":4733,"date":"2016-10-18T13:35:05","date_gmt":"2016-10-18T17:35:05","guid":{"rendered":"http:\/\/ncjolt.org\/?p=4733"},"modified":"2020-06-04T20:52:59","modified_gmt":"2020-06-04T20:52:59","slug":"driverless-cars-liability-breakthrough","status":"publish","type":"post","link":"https:\/\/journals.law.unc.edu\/ncjolt\/blogs\/driverless-cars-liability-breakthrough\/","title":{"rendered":"Driverless Cars: Liability or Breakthrough?"},"content":{"rendered":"<p>The emergence of driverless cars is an exciting prospect, but some are concerned that the growing popularity will lead to \u201c<span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.glassbytes.com\/2016\/10\/law-professor-predicts-shift-in-liability-focus-with-driverless-cars\/http:\/www.glassbytes.com\/2016\/10\/law-professor-predicts-shift-in-liability-focus-with-driverless-cars\/\">a shift in the focus<\/a><\/span> of liability insurance from personal fault to product safety.\u201d Since automobile accidents constitute the<span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.glassbytes.com\/2016\/10\/law-professor-predicts-shift-in-liability-focus-with-driverless-cars\/\"> largest category<\/a><\/span> of tort claims, the focus will be on these new, driverless cars. Professor Michael Rustad, who is the co-director of the Intellectual Property Law Concentration at Suffolk University Law School, thinks that law suits will <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.glassbytes.com\/2016\/10\/law-professor-predicts-shift-in-liability-focus-with-driverless-cars\/\">change<\/a><\/span> from driver accident claims to claims against \u201ccar and component part manufacturers, including the software vendors.\u201d<br \/>\nThe liability issues with driverless cars are concerning. A driverless car in California operated under Nissan\u2019s \u201cCruise Automation\u201d system <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.lexology.com\/library\/detail.aspx?g=7928e78d-07d2-4eff-8912-5f997ab2e4f9\">ran into<\/a><\/span> a parked car after the car\u2019s passenger tried to take control from the system. Since driverless cars are a new concept, there are relatively few laws on the books. Most states don\u2019t explicitly reference driverless cars, either \u201cbecause <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"https:\/\/theringer.com\/driverless-cars-google-state-laws-5523af5ac21d#.99dx6n3jw\">early bills<\/a><\/span> have died in state legislatures or lawmakers are taking a wait-and-see approach.\u201d One article suggests that the issue of <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.slate.com\/articles\/technology\/future_tense\/2016\/06\/if_a_driverless_car_crashes_who_is_liable.html\">liability<\/a><\/span> should be left to the tort system; liability has long been handled through strict liability, negligence, and warranty; basically, what has always governed automobile accidents. However, the lack of guidance on this issue may mean that the liability falls on the <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.slate.com\/articles\/technology\/future_tense\/2016\/06\/if_a_driverless_car_crashes_who_is_liable.html\">manufacturers<\/a><\/span> of driverless cars \u2013 and this may lead to a large incentive to sue frivolously, overworking the legal system and driving up legal costs. While driverless cars are <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.vtti.vt.edu\/PDFs\/Automated%20Vehicle%20Crash%20Rate%20Comparison%20Using%20Naturalistic%20Data_Final%20Report_20160107.pdf\">projected<\/a><\/span> to be safer than cars driven by people, there is still a huge potential for accidents, and the liability for these accidents could go in a variety of directions. It is also important to note that because of the novelty of self driving cars,<\/p>\n<blockquote><p>all that is needed to operate a driverless car is the \u201c<span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.theatlantic.com\/technology\/archive\/2016\/09\/anybody-can-test-a-self-driving-car-in-pennsylvania\/499667\/\">right technology<\/a><\/span>\u201d; no one needs a special permit or license, and there is no such thing at this time as a self driving car safety clearance.<\/p><\/blockquote>\n<p>&nbsp;<br \/>\nIn addition to liability issues with self driving cars, there is also fear of hacking. A traffic safety manager at AAA, Steve Phillips, says that criminals can<span style=\"color: #0000ff\"> <a style=\"color: #0000ff\" href=\"http:\/\/wncn.com\/2016\/05\/23\/researchers-work-to-keep-hackers-out-of-your-cars-computer-system\/\">jam signals<\/a><\/span> between key fobs and the car in question; with the increasing computerization of cars, there is a risk of criminals being able to unlock and start targeted automobiles.<br \/>\nNorth Carolina is not immune to the driverless car fanfare; N.C. Vision Zero wants to bring driverless cars to the roads in order to cut down the 1,317 North Carolina traffic accident deaths down to <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.newsobserver.com\/news\/politics-government\/state-politics\/article105753976.html\">zero<\/a><\/span>. It is alleged that over <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.dailytarheel.com\/article\/2015\/01\/google-moves-forward-with-driverless-cars\">ninety percent<\/a><\/span> of car accidents are because of human error. North Carolina\u2019s plan is to end all deaths from traffic accidents within thirty years. According to North Carolina Transportation Secretary Nick Tennyson, ending all deaths is \u201can ambitious <span style=\"color: #0000ff\"><a style=\"color: #0000ff\" href=\"http:\/\/www.wilsontimes.com\/stories\/State-campaign-aiming-for-zero-traffic-fatalities,74346\">goal<\/a><\/span>, but it is not beyond our reach.\u201d While the goal is admirable, the lack of law surrounding self driving cars and the uncertainty of liability is concerning.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The emergence of driverless cars is an exciting prospect, but some are concerned that the growing popularity will lead to \u201ca shift in the focus of liability insurance from personal fault to product safety.\u201d Since automobile accidents constitute the largest category of tort claims, the focus will be on these new, driverless cars.
