In the wake of press reports of abusive patent behavior, the\u00a0North Carolina legislature followed other states and passed a state
\nlaw designed to curb abusive patent practices. The Abusive Patents\u00a0Assertions Act (the Act), passed in 2014, creates a state law tort\u00a0action for a bad faith assertion of patent infringement. A business\u00a0that believes it has been targeted by a baseless assertion of patent\u00a0rights can bring suit under the law or bring a counterclaim to\u00a0patent infringement. The Act provides many other benefits, such as\u00a0the ability of the Attorney General to join the case, and requires\u00a0the patent holder to put up a bond to ensure it pays damages in the\u00a0event that it loses. While the Act provides benefits, because patent\u00a0law is federal subject matter, the Act also might be vulnerable to\u00a0preemption by Federal law.<\/p>\n","protected":false},"excerpt":{"rendered":"
