The United States\u00a0Environmental Protection Agency\u2019s (\u201cEPA\u201d) Clean Power Plan\u00a0seeks to address the hazards posed by the electricity sector, and\u00a0proposes carbon dioxide (\u201cCO2\u201d) emissions trading as an\u00a0efficient, cost-effective option to do so. This Recent Development\u00a0argues that the Clean Power Plan should be upheld with respect to\u00a0emissions trading. First, a reasonable interpretation of section\u00a0111(d) of the Clean Air Act (\u201cCAA\u201d) provides a legal basis for\u00a0carbon dioxide emissions trading. Second, a thorough analysis of\u00a0North Carolina\u2019s legislative history provides an example of why\u00a0carbon dioxide emissions trading is legal without authorization\u00a0from state general assemblies. Further, emissions trading allows\u00a0for easier Clean Power Plan compliance by power plants.
