{"id":1452,"date":"2013-02-12T20:43:11","date_gmt":"2013-02-12T20:43:11","guid":{"rendered":"http:\/\/ncjolt.org\/?p=1452"},"modified":"2020-06-04T20:54:03","modified_gmt":"2020-06-04T20:54:03","slug":"cyber-security-in-2013","status":"publish","type":"post","link":"https:\/\/journals.law.unc.edu\/ncjolt\/blogs\/cyber-security-in-2013\/","title":{"rendered":"Cyber Security in 2013"},"content":{"rendered":"<p>Sunday, February 10, 2013 by Cara Richards<br \/>\nSince the Cybersecurity Act of 2012 was blocked from coming to a vote last year, Senator Rockefeller, Chairman of the Senate Commerce, Science, and Transportation Committee, sent a <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1359921419004&amp;Sen_Rockefeller_Hears_CEO_Support_for_Cybersecurity_Legislation\">questionnaire<\/a> to all of the CEO\u2019s of the Fortune 500, looking to gauge opinions and responses toward cyber security law. A committee reviewed the responses and released some of its findings in a memo in anticipation of the introduction of the Cybersecurity and American <a href=\"http:\/\/commerce.senate.gov\/public\/?a=Files.Serve&amp;File_id=b678eb9a-b5c1-4540-aca3-3e857c7627da\">Cyber Competitiveness<\/a> Act of 2013.<br \/>\nThe 2012 bill was met with strong <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1359921419004&amp;Sen_Rockefeller_Hears_CEO_Support_for_Cybersecurity_Legislation\">opposition<\/a>, particularly from the U.S. Chamber of Commerce. Yet, 80 percent of the top 100 companies answered the questionnaire, with a total of 300 responses in all, revealing that companies in the private sector were not deeply opposed to this cyber <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1359921419004&amp;Sen_Rockefeller_Hears_CEO_Support_for_Cybersecurity_Legislation\">legislation<\/a>. The companies that responded reported already taking steps to protect their companies\u2019 infrastructures from cyber attacks. The summary <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1359921419004&amp;Sen_Rockefeller_Hears_CEO_Support_for_Cybersecurity_Legislation\">memo stated<\/a> that \u201cmany companies supported a voluntary program to protect critical infrastructure, so long as it would not become mandatory\u201d and\u00a0 many of the companies that responded \u201csupported more robust, two-way cyber threat information sharing\u201d and \u201cgreater access to security clearances to ease the process.\u201d Based on the questionnaire, companies seemed supportive of new cyber security legislation. However, corporations still expressed some <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1359921419004&amp;Sen_Rockefeller_Hears_CEO_Support_for_Cybersecurity_Legislation\">concerns<\/a> about the legislation, fearing \u201cinflexible\u201d and \u201cad-hoc\u201d approaches. Overall though, the <a href=\"http:\/\/www.law.com\/jsp\/lawtechnologynews\/PubArticleLTN.jsp?id=1359921419004&amp;Sen_Rockefeller_Hears_CEO_Support_for_Cybersecurity_Legislation\">committee found<\/a> that the concerns \u201cwere generally related to the manner in which [the legislation] would be implemented, not with the fundamental notion of whether to create it.\u201d<br \/>\nIn support of the new legislation, Rockefellar <a href=\"http:\/\/commerce.senate.gov\/public\/index.cfm?p=PressReleases&amp;ContentRecord_id=7a7124d7-190c-4160-abf3-4012c2db737c&amp;ContentType_id=77eb43da-aa94-497d-a73f-5c951ff72372&amp;Group_id=4b968841-f3e8-49da-a529-7b18e32fd69d\">commented<\/a>, \u201cThe private sector and the government must work together to secure the networks that are vital to American businesses and communities. It is a priority this year to act on comprehensive cybersecurity legislation.\u201d Senator Feinstein also <a href=\"http:\/\/commerce.senate.gov\/public\/index.cfm?p=PressReleases&amp;ContentRecord_id=7a7124d7-190c-4160-abf3-4012c2db737c&amp;ContentType_id=77eb43da-aa94-497d-a73f-5c951ff72372&amp;Group_id=4b968841-f3e8-49da-a529-7b18e32fd69d\">commented<\/a> on the necessity of this legislation, \u201cThe threat of a cyber attack is real, and it is growing. Congress must act soon to improve the government\u2019s ability to share and receive information on cyber attacks and threats with the private sector. Our national and economic security depend on robust information sharing. . .\u201d The Cybersecurity and American Cyber Competitiveness Act of 2013 is cosponsored by Senators John D.
