Follow FALR on\u00a0<\/i><a href=\"https:\/\/twitter.com\/FirstAmendLRev\"><i>Twitter<\/i><\/a><i>\u00a0and\u00a0<\/i><a href=\"https:\/\/www.facebook.com\/firstamendmentlawreview\"><i>Facebook<\/i><\/a><i>\u00a0for regular updates.<\/i><\/p>\n<p><img loading=\"lazy\" class=\"alignnone size-full wp-image-1975\" src=\"https:\/\/journals.law.unc.edu\/firstamendmentlawreview\/wp-content\/uploads\/sites\/8\/2018\/03\/5686167411_db6cbb722f_b.jpg\" alt=\"5686167411_db6cbb722f_b\" width=\"800\" height=\"472\" srcset=\"https:\/\/journals.law.unc.edu\/firstamendmentlawreview\/wp-content\/uploads\/sites\/8\/2018\/03\/5686167411_db6cbb722f_b.jpg 800w, https:\/\/journals.law.unc.edu\/firstamendmentlawreview\/wp-content\/uploads\/sites\/8\/2018\/03\/5686167411_db6cbb722f_b-300x177.jpg 300w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/p>\n<p>Photo Credit: Courtesy of <a href=\"https:\/\/www.flickr.com\/photos\/karbk\/5686167411\" target=\"_blank\" rel=\"noopener\">Karthik BK<\/a><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Federal Court News<\/strong><\/em><\/p>\n<p>The Ninth Circuit found that the City of Long Beach\u2019s zoning rules violated the First Amendment by unreasonably restricting prospective business owners&#8217; options for establishing new <a href=\"https:\/\/lbpost.com\/news\/first-amendment-suit-forces-long-beach-to-alter-zoning-for-tattoo-shops\/\">tattoo shops<\/a>.<\/p>\n<p>After the ACLU filed a federal lawsuit saying a <a href=\"http:\/\/abcnews.go.com\/US\/wireStory\/aclu-sues-georgia-city-sign-ban-city-reverses-53796644\">blanket sign ban<\/a> during a Vice President Mike Pence appearance at a St. Patrick\u2019s day parade would violate the free speech rights of parade attendees, the city of Savannah reversed course and announced signs would be allowed at the event.<\/p>\n<p>The ACLU filed a federal lawsuit alleging the New Orleans permit requirement for large murals is unconstitutional after the city accused a muralist of a zone violation for a <a href=\"http:\/\/wgno.com\/2018\/03\/13\/aclu-files-first-amendment-lawsuit-over-mural-featuring-controversial-trump-quote\/\">mural featuring a controversial Trump quote<\/a>.<\/p>\n<p>The 10<sup>th<\/sup> Circuit upheld the constitutionality of <a href=\"https:\/\/www.courthousenews.com\/utahs-expansion-of-ballot-access-okd-by-10th-circuit\/\">Utah Senate Bill 54<\/a>, which creates an alternative avenue for candidates to qualify for primaries by collecting signatures, despite arguments that this bill infringes on the First Amendment associational rights of political parities.<\/p>\n<p>The New York City Police department is facing a class action lawsuit, which alleges that the police department\u2019s policy of <a href=\"https:\/\/www.courthousenews.com\/nypd-sued-over-ban-on-headscarves-in-mug-shots\/\">requiring Muslims to remove their religious headscarves for arrest photos<\/a> violates the First Amendment\u2019s free exercise clause.<\/p>\n<p><!--more--><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>State Court News<\/strong><\/em><\/p>\n<p>The West Virginia Supreme Court ruled that completely <a href=\"https:\/\/www.wvgazettemail.com\/news\/cops_and_courts\/wv-supreme-court-complete-internet-restriction-violates-st-amendment\/article_7f686619-49a5-5773-b18e-b8934cc62296.html\">restricting a person\u2019s access to the Internet<\/a> as a condition of their parole violates the First Amendment.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Federal Legislative News<\/strong><\/em><\/p>\n<p>Utah Senator Mike Lee and 21 other lawmakers have reintroduced the <a href=\"https:\/\/www.nbcnews.com\/feature\/nbc-out\/gop-reintroduces-bill-pitting-religious-freedom-against-gay-marriage-n855836\">First Amendment Defense Act<\/a> in Congress. The bill, according to its supporters is \u201cdesigned to prevent the federal government from discriminating against individuals or institutions based on their beliefs about marriage.&#8221;<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Other News<\/strong><\/em><\/p>\n<p>News outlets report that the Trump administration allegedly <a href=\"https:\/\/www.nytimes.com\/2018\/03\/21\/us\/politics\/trump-nondisclosure-agreement.html\">required senior White House officials to sign nondisclosure agreements<\/a>, potentially violating the First Amendment if enforced.<\/p>\n<p>More than one million people were expected to attend the <a href=\"https:\/\/www.usatoday.com\/story\/news\/2018\/03\/24\/live-stream-march-our-lives-rally\/451679002\/\">March for Our Lives<\/a>\u00a0event in Washington, D.C., and sibling marches around the country, on March 24 to exercise their First Amendment rights to advocate for gun regulations and school safety.<\/p>\n<p>A Nevada high school student was suspended after calling a Northern Nevada Congressman\u2019s office and using \u201c<a href=\"https:\/\/www.reviewjournal.com\/news\/politics-and-government\/nevada\/reno-student-suspended-after-call-to-nevada-congressman\/\">offensive, disrespectful and vulgar<\/a>\u201d language. The suspension has since been <a href=\"http:\/\/mynews4.com\/news\/local\/wcsd-revokes-suspension-of-mcqueen-student-who-dropped-f-bomb-in-call-to-amodeis-office\">revoked<\/a> following public outcry.<\/p>\n<p>&nbsp;<\/p>\n<p><i>That\u2019s it for your First Amendment Newsflash March 12-25, 2018.
