The descriptions of unsanitary working conditions and animal cruelty inspired the passage of legislation relating to food quality and production. Over a century later, activists still model undercover investigations after this blueprint. While advanced technology has made documenting the conditions on factory farms easier, potential whistleblowers in the U.S. must now worry about violating \u201cAg-Gag\u201d laws.<\/p>\n<p>What is an Ag-Gag law? Imagine you are an animal rights activist who secures employment on a dairy farm in order to uncover any animal abuse that may be committed there. You do not reveal your affiliation because the farm would not hire you otherwise, and it will not matter if you do not uncover any abuse. While there, some of your co-workers put a chain around a cow\u2019s neck and drag the cow across a concrete floor using a tractor. You record a video of the incident and release it, hoping it will at least result in criminal charges for those who perpetrated the abuse and in well-deserved negative publicity for the industry. However, you discover that you have been charged with the crime of \u201cInterference with Agricultural Production\u201d because you gained access to the facility through misrepresentation and failed to secure the owner\u2019s consent before recording on the premises.<\/p>\n<p><!--more--><\/p>\n<p>It was an <a href=\"http:\/\/usnews.nbcnews.com\/_news\/2012\/10\/10\/14343360-torment-of-dairy-cows-in-undercover-video-leads-to-cruelty-charges?lite.\">incident<\/a> much like this one that lead to Idaho\u2019s passage of an \u201cAg-Gag\u201d law codified at <a href=\"https:\/\/legislature.idaho.gov\/statutesrules\/idstat\/title18\/t18ch70\/sect18-7042\/\">I.C. \u00a7 18-7042<\/a>. However, this law, and other \u201cAg-Gag\u201d laws across the country have been found unconstitutional due to their facial First Amendment implications. This has led to <a href=\"http:\/\/www.kunc.org\/post\/ag-http:\/www.kunc.org\/post\/ag-gag-struck-down-utah-animal-rights-groups-set-sights-midwest%20gag-struck-down-utah-animal-rights-groups-set-sights-midwest\">speculation<\/a> that North Carolina\u2019s \u201cAg-Gag\u201d law, <a href=\"https:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v5.pdf\">The Property Protection Act<\/a>, may soon be overturned. The Act is considered by some critics to be <a href=\"https:\/\/news.vice.com\/article\/north-carolinas-ag-gag-law-might-be-the-worst-in-the-nation\">the worst \u201cAg-gag\u201d law in the country<\/a>. While it implicates even more protected speech than previously overturned \u201cAg-Gag\u201d statutes, a recent challenge to the law in<a href=\"http:\/\/www.ncmd.uscourts.gov\/sites\/ncmd\/files\/opinions\/16cv25moo.pdf\"> <em>PETA v. Stein<\/em><\/a> was dismissed due to the unique structure of this law.<\/p>\n<p><strong>First Amendment Implications of The Property Protection Act<\/strong><\/p>\n<p><a href=\"https:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v5.pdf\">The Property Protection Act<\/a> targets the same elements of typical \u201cAg-gag\u201d legislation, mainly: (1) gaining access to premises through misrepresentation, and (2) recording without consent of the owner. The Act makes its first divergence in its scope. Previous \u201cAg-gag\u201d legislation earned its moniker due to its focus on industrial agriculture facilities. <a href=\"https:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v5.pdf\">The Property Protection Act<\/a> has gone further by simply applying to <a href=\"https:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v5.pdf\">\u201cthe nonpublic areas of an employer\u2019s premises\u201d.<\/a><\/p>\n<p>When the bill appeared on his desk<a href=\"http:\/\/www.newsobserver.com\/news\/politics-government\/article22605054.html\">, it was vetoed<\/a> by former Governor Pat McCrory, who believed that it did not provide enough protections for legitimate whistleblowers and that employees would be discouraged from reporting illegal activity. For example, the AARP <a href=\"http:\/\/www.newsobserver.com\/news\/politics-government\/article22605054.html\">pointed out<\/a> that under this law, a nursing home worker could be liable for documenting elder abuse. Despite opposition, the bill <a href=\"http:\/\/www.wral.com\/lawmakers-override-mccrory-veto-on-controversial-private-property-bill\/14687952\/\">overcame<\/a> the veto and became law in 2016, just months after an animal rights group <a href=\"http:\/\/civileats.com\/2017\/06\/26\/transparency-north-carolina-factory-farms\/\">released a video<\/a> of an employee at a North Carolina poultry farm throwing, kicking, and stomping on chickens.<\/p>\n<p>The bill\u2019s sponsor, Rep. Szoka, believes these complaints are <a href=\"http:\/\/www.newsobserver.com\/news\/politics-government\/state-politics\/article52341745.html\">unfounded<\/a> and that employees could still report issues to the proper authorities, but that the proper authorities are <a href=\"http:\/\/www.newsobserver.com\/news\/politics-government\/state-politics\/article52341745.html\">\u201cnot the media and not special interest organizations.\u201d<\/a> While he made assurances that the law would not harm long-term employees who discover wrongdoing at work, the law makes no such distinction among employees. Worse, the law writes out any discretion on the part of the government in its application.<\/p>\n<p><strong>So Why Is The Property Protection Act Still Law?<\/strong><\/p>\n<p>The biggest difference between <a href=\"https:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v5.pdf\">North Carolina\u2019s Property Protection Act<\/a> and typical \u201cAg-gag\u201d legislation is that the North Carolina law creates a civil cause of action for business owners as opposed to a criminal penalty for violators. Courts typically have <a href=\"https:\/\/www.thefire.org\/ninth-circuit-ruling-creates-unjust-barrier-for-first-amendment-plaintiffs\/\">relaxed standing requirements<\/a> for establishing an injury when a law\u2019s constitutionality is challenged; plaintiffs are not required to undergo a criminal prosecution to seek relief; and a credible threat of prosecution under a law is enough for a cognizable injury.<\/p>\n<p>Unfortunately, courts have been stopped short of applying the same reasoning to the possibility of a civil suit between citizens. This was precisely the reason why the challenge to <a href=\"https:\/\/www.ncleg.net\/Sessions\/2015\/Bills\/House\/PDF\/H405v5.pdf\">the Property Protection Act<\/a> in <em>PETA v. Stein<\/em> was dismissed. Unlike a threat of criminal prosecution, the threat of a lawsuit was proclaimed <a href=\"http:\/\/www.ncmd.uscourts.gov\/sites\/ncmd\/files\/opinions\/16cv25moo.pdf\">\u201ctoo speculative\u201d<\/a> by the court. While an appeal has been filed, a favorable outcome for the plaintiffs seems unlikely.<\/p>\n<p>This scenario was likely contemplated by the drafters of the legislation. The creation of private tort remedies against otherwise constitutional activity has found alarming success in other <a href=\"https:\/\/scholar.google.com\/scholar_case?case=13702893519867419484&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\">contexts<\/a>, and \u201cAg-gag\u201d laws across the country had been <a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2017\/07\/08\/536186914\/judge-overturns-utahs-ag-gag-ban-on-undercover-filming-at-farms\">overturned<\/a> prior to the Act\u2019s passage. The Act has been seemingly insulated from any pre-enforcement challenges to its constitutionality. Meanwhile, the Act continues to chill the speech of those who may be too worried about large civil penalties and legal fees to risk blowing the whistle.<\/p>\n<p><strong>How Should Activists and Workers in North Carolina Proceed?<\/strong><\/p>\n<p>The law will almost certainly survive any facial challenges to its constitutionality due to a lack of standing. There is still a possibility that anyone sued under the law could successfully argue that such a suit violates his or her First Amendment rights, but the possibility for massive civil liability may prove too much for potential whistleblowers. Most do not care to know how the sausage is made.
