refused to block the <a href=\"https:\/\/www.washingtonpost.com\/national\/judge-refuses-to-block-removal-of-confederate-monument\/2018\/01\/26\/3a33ceb4-02dc-11e8-86b9-8908743c79dd_story.html?utm_term=.164beb5eacc3\">removal of a Confederate monument<\/a> on courthouse grounds in north Louisiana after the United Daughters of the Confederacy filed a First Amendment claim.<\/p>\n<p>The Trump administration filed court documents supporting a lawsuit against the <a href=\"https:\/\/www.washingtonpost.com\/national\/higher-education\/trump-administration-supports-suit-over-berkeley-speakers\/2018\/01\/25\/6fa3cc70-0232-11e8-86b9-8908743c79dd_story.html?utm_term=.6d84b133dd6e\">University of California, Berkley<\/a> accusing the school of violating the First Amendment by restricting campus speakers with conservative viewpoints.<\/p>\n<p>A federal judge threw out a defamation lawsuit over the <a href=\"https:\/\/www.washingtonpost.com\/national\/judge-axes-lawsuit-over-sites-hate-group-label-on-charities\/2018\/01\/24\/3adf4f50-0133-11e8-86b9-8908743c79dd_story.html?utm_term=.d171b997569d\">\u201chate group\u201d label<\/a> that dozens of nonprofit groups received on a website database of U.S. charities.<\/p>\n<p>A federal judge ordered the University of Iowa to <a href=\"https:\/\/www.washingtonpost.com\/national\/higher-education\/group-to-be-temporarily-reinstated-at-ui-on-judges-order\/2018\/01\/23\/23130b7c-0099-11e8-86b9-8908743c79dd_story.html?utm_term=.2a2fcd7cacac\">temporarily reinstate a conservative Christian organization<\/a> as a registered student organization after the university revoked campus registration when the group denied a leadership position to a gay student who would not affirm a statement of faith rejecting homosexuality.<\/p>\n<p>The parties involved in a federal lawsuit, claiming a woman\u2019s First Amendment rights were violated after a\u00a0<a href=\"https:\/\/www.washingtonpost.com\/national\/lawsuit-over-officer-seizing-phone-deleting-photo-settled\/2018\/01\/19\/7c20acb4-fd61-11e7-9b5d-bbf0da31214d_story.html?utm_term=.882497613242\">police officer grabbed her phone and deleted a photo<\/a> she took of her son in the officer\u2019s vehicle, reached a settlement.<\/p>\n<p>A federal judge temporarily blocked a Kansas law <a href=\"https:\/\/www.nytimes.com\/aponline\/2018\/01\/30\/us\/ap-us-kansas-israel-boycott.html\">prohibiting state contractors from participating in boycotts against Israel<\/a>, ruling that the state law violates state contractors free speech rights.<\/p>\n<p><!--more--><\/p>\n<p>The <a href=\"https:\/\/www.rcfp.org\/warrantless-searches-devices-border-violate-travelers%E2%80%99-first-amendment-rights-reporters-committee-an\">Reporters Committee for Freedom of the Press<\/a> and other First Amendment advocacy groups filed amicus briefs to deny a request from the U.S. Department of Homeland Security to dismiss a lawsuit challenging the constitutionality of warrantless search and seizure of electronic devices at the border, stating that these searches violate First Amendment rights.<\/p>\n<p>A Chicago court clerk is appealing a federal district court opinion after a federal judge found that the First Amendment prohibits the clerk from <a href=\"https:\/\/www.courthousenews.com\/chicago-clerk-appeals-first-amendment-ruling-on-press-access\/\">withholding new electronic filings<\/a> from the press.<\/p>\n<p>A federal judge struck down <a href=\"https:\/\/www.courthousenews.com\/federal-judge-strikes-down-floridas-ex-felon-voting-ban\/\">process for re-establishing voting rights<\/a> for ex-felons as arbitrary and unconstitutional after several ex-felons brought a class-action lawsuit claiming the process for re-establishing voting rights violated the First Amendment and Fourteenth Amendment.<\/p>\n<p>The Ninth Circuit ruled that an Oregon school district violated the Constitution when it <a href=\"https:\/\/www.courthousenews.com\/circuit-blasts-school-district-for-free-speech-violations\/\">banned striking teachers from school grounds<\/a> as well as any students who publicly supported the strike.<\/p>\n<p><a href=\"https:\/\/www.courthousenews.com\/inauguration-day-protesters-file-false-arrest-lawsuit\/\">Inauguration day protestors<\/a> filed a federal class action complaint against a police department for false arrest claiming police officers failed to distinguish actual rioters from peaceful protestors during mass arrest.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>State Court News<\/strong><\/em><\/p>\n<p>The Arizona Court of Appeals ruled that a judge\u2019s order banning the media from publishing a prosecutor\u2019s name in a murder trial amounted to a <a href=\"https:\/\/www.washingtonpost.com\/national\/appeals-court-judges-order-infringed-on-medias-rights\/2018\/01\/23\/48e5354e-0073-11e8-86b9-8908743c79dd_story.html?utm_term=.f0aa507a9f29\">prior restraint<\/a> of the First Amendment right to report on the case.<\/p>\n<p>The Washington Supreme Court ruled that a fire department violated a firefighter\u2019s free speech rights when it <a href=\"https:\/\/www.courthousenews.com\/washington-court-rules-fire-department-violated-firefighters-free-speech\/\">restricted his ability to include religious comments<\/a> in work emails and forums.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>State Legislation News<\/strong><\/em><\/p>\n<p>The California senate approved a <a href=\"https:\/\/www.courthousenews.com\/california-senate-clears-net-neutrality-bill\/\">net neutrality bill<\/a> that would prevent internet service providers from charging websites for quicker access.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Other News<\/strong><\/em><\/p>\n<p>Prosecutors and the judge in Larry Nassar\u2019s sexual assault case thanked <a href=\"https:\/\/www.washingtonpost.com\/national\/prosecutor-praises-newspaper-that-exposed-doctors-abuse\/2018\/01\/24\/7b8ced5c-0140-11e8-86b9-8908743c79dd_story.html?utm_term=.e942cbe022a9\">investigative journalism<\/a> and the First Amendment for exposing the doctor\u2019s abuse.<\/p>\n<p>North Carolina\u2019s prison system dropped its ban on <a href=\"https:\/\/www.nytimes.com\/2018\/01\/24\/us\/new-jim-crow-north-carolina.html\">\u201cThe New Jim Crow,\u201d<\/a> a best-selling book about the connection between mass incarceration and racism, and will review other prohibited books after the state\u2019s ACLU affiliate challenged the ban.<\/p>\n<p>Freedom of the Press Foundation announced it will begin <a href=\"https:\/\/www.nytimes.com\/2018\/02\/01\/business\/media\/gawker-archives-press-freedom.html\">archiving online content<\/a> it deems at risk of being depleted or manipulated, starting with Gawker and L.A.
