\/><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Federal Court News<\/strong><\/em><\/p>\n<p>Parties in a federal lawsuit that accused a Louisiana police officer of violating a woman\u2019s First Amendment rights by grabbing her cellphone and deleting a photo she took of the officer <a href=\"https:\/\/www.washingtonpost.com\/national\/lawsuit-over-officer-seizing-phone-deleting-photo-settled\/2018\/01\/19\/7c20acb4-fd61-11e7-9b5d-bbf0da31214d_story.html?utm_term=.a4302d1e0498\">reached a settlement<\/a> that includes officer training on the public\u2019s First Amendment right to photograph police performing their duties.<\/p>\n<p>The Ninth Circuit dismissed a <a href=\"https:\/\/www.washingtonpost.com\/news\/morning-mix\/wp\/2018\/01\/18\/they-argued-that-prostitution-is-a-constitutional-right-nice-try-said-federal-court\/?utm_term=.fec2e3e65e1c\">sex worker advocacy group\u2019s lawsuit<\/a> claiming that prostitution should be a First Amendment-protected form of commercial speech.<\/p>\n<p>The Justice Department backs Archdiocese of Washington in its court appeal to have its <a href=\"https:\/\/www.washingtonpost.com\/business\/justice-dept-backs-archdiocese-in-christmas-subway-ad-fight\/2018\/01\/16\/de44c104-fb0a-11e7-9b5d-bbf0da31214d_story.html?utm_term=.2260200a0ceb\">Christmas fundraising ads<\/a> displayed on Washington, D.C. public transportation.<\/p>\n<p>A man, whose 1989 Supreme Court case granted First Amendment protection for flag burning, sued the City of Cleveland and others for their roles in his arrest after he <a href=\"https:\/\/www.washingtonpost.com\/national\/man-arrested-during-gop-convention-sues-city-police\/2018\/01\/11\/7289c796-f6f7-11e7-9af7-a50bc3300042_story.html?utm_term=.68e5095caf44\">tried to burn a flag<\/a> at the Republican national Convention in 2016.<\/p>\n<p>A federal court ruled that Republicans in North Carolina unconstitutionally violated <a href=\"https:\/\/www.washingtonpost.com\/news\/morning-mix\/wp\/2018\/01\/10\/federal-court-voids-north-carolinas-gop-drawn-congressional-map-for-partisan-gerrymandering\/?utm_term=.b18b13e0fb87\">voters\u2019 First Amendment rights<\/a> by gerrymandering congressional districts in 2016 to ensure Republican victory.<\/p>\n<p>Federal court reject\u2019s terminated <a href=\"https:\/\/www.insidehighered.com\/news\/2018\/01\/15\/court-rejects-first-amendment-suit-professor-fired-over-her-use-profanity\">Louisiana State University professor\u2019s First Amendment suit against the university<\/a>, stating that there is no meaningful connection between her vulgar and sexually explicit language and her training future elementary school teachers.<\/p>\n<p>The Second Circuit applied the First Amendment to grant a right for a <a href=\"https:\/\/www.cincinnati.com\/story\/money\/2018\/01\/11\/first-amendment-protects-slur-food-truck-logo\/1024400001\/\">food truck vendor to use an ethnic slur<\/a> in branding for his company.<\/p>\n<p><!--more--><\/p>\n<p>The Ninth Circuit rules California law that prohibited merchants from imposing <a href=\"https:\/\/www.natlawreview.com\/article\/ninth-circuit-rules-california-no-credit-card-surcharge-law-violates-first-amendment\">surcharges on credit card purchases<\/a> violated the First Amendment right to free speech by restricting how vendors could communicate that an additional amount is charged for credit card purchases.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>State Court News<\/strong><\/em><\/p>\n<p>A Virginia man asks the Virginia Supreme Court to overturn his six month jail conviction for <a href=\"https:\/\/www.washingtonpost.com\/national\/virginia-man-asks-court-to-toss-out-conviction-in-noose-case\/2018\/01\/10\/e721c0ee-f63f-11e7-9af7-a50bc3300042_story.html?utm_term=.2479c628cb74\">hanging a black-faced dummy by a noose<\/a> in his front yard to intimidate neighbors, arguing his First Amendment free speech rights were violated.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Federal Regulations<\/strong><\/em><\/p>\n<p>The U.S. Department of Health and Human Services\u2019 civil rights division will now provide protection for <a href=\"https:\/\/www.washingtonpost.com\/news\/to-your-health\/wp\/2018\/01\/18\/new-hhs-civil-rights-division-charged-with-protecting-health-workers-with-moral-objections\/?utm_term=.a5a8df09a589\">health-care workers who refuse to provide services<\/a> that run counter to their moral or religious convictions.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Other News<\/strong><\/em><\/p>\n<p>The University of Alabama expelled a freshman after her <a href=\"https:\/\/www.washingtonpost.com\/news\/grade-point\/wp\/2018\/01\/19\/she-was-expelled-from-college-after-her-racist-rants-went-viral-her-mother-thinks-she-deserves-it\/?utm_term=.6f9d3c300ebf\">racial rants went viral<\/a> on social media.<\/p>\n<p>Michigan State University will allow <a href=\"https:\/\/www.washingtonpost.com\/news\/grade-point\/wp\/2018\/01\/18\/michigan-state-agrees-to-let-richard-spencer-give-a-speech-on-campus\/?utm_term=.476459c43cb5\">white nationalist Richard Spencer to speak on campus<\/a>, after settling a First Amendment lawsuit brought by a Spencer supporter.<\/p>\n<p>A U.S. Energy Department photographer is seeking <a href=\"https:\/\/www.washingtonpost.com\/business\/economy\/rick-perry-hugged-a-coal-baron-this-photographer-got-the-picture-then-he-lost-his-job\/2018\/01\/17\/ac52a2a8-fbd0-11e7-ad8c-ecbb62019393_story.html?utm_term=.c476484e670e\">whistleblower protection<\/a> after the department placed him on administrative leave for releasing a photo of the Secretary of Energy hugging a coal baron.<\/p>\n<p>A Louisiana teacher is contemplating a lawsuit after she was forcefully ejected and handcuffed in a <a href=\"https:\/\/www.washingtonpost.com\/national\/teacher-board-head-should-resign-marshal-needs-training\/2018\/01\/11\/4e558846-f734-11e7-9af7-a50bc3300042_story.html?utm_term=.8894ee2ad2a7\">video-recorded arrest<\/a> for questioning her superintendent\u2019s pay raise.<\/p>\n<p>Iowa State University will pay $150,000 to two student leaders of a pro-marijuana advocacy group for unconstitutionally banning the <a href=\"https:\/\/www.washingtonpost.com\/national\/higher-education\/iowa-states-push-to-ban-marijuana-shirt-leads-to-huge-costs\/2018\/01\/09\/38b1eae8-f568-11e7-9af7-a50bc3300042_story.html?utm_term=.75971353282b\">student group\u2019s T-shirts<\/a>.<\/p>\n<p>New Jersey prisons announced that it will now make\u00a0 <a href=\"https:\/\/www.washingtonpost.com\/national\/aclu-wants-prisons-to-end-ban-on-mass-incarceration-book\/2018\/01\/08\/af7a64ac-f491-11e7-9af7-a50bc3300042_story.html?utm_term=.cc81d3b888d6\">\u201cThe New Jim Crow,\u201d<\/a> a best-selling book on mass incarceration and racial disparity, available to inmates after civil rights groups challenged a previous ban of the book in two state prisons.<\/p>\n<p>Trump announced his \u201cFake News Awards\u201d while <a href=\"http:\/\/beta.latimes.com\/politics\/la-na-pol-fake-news-trump-20180117-story.html\">two Republican lawmakers<\/a>
