to determine whether partisan gerrymandering retaliates against voters for their past support of a party\u2019s candidate, violating the First Amendment.<\/p>\n<p>A federal judge rejected a Catholic organization\u2019s request to force metro to post its <a href=\"https:\/\/www.washingtonpost.com\/local\/trafficandcommuting\/judge-supports-metros-decision-to-ban-christmas-themed-catholic-ads\/2017\/12\/09\/97ecec50-dd1d-11e7-a841-2066faf731ef_story.html?utm_term=.a2f52d35cf3b\">Christmas advertisements<\/a>, affirming that the transit agency\u2019s decision to ban posters featuring a religious-themed scene does not violate an organization\u2019s First Amendment right.<\/p>\n<p>Federal appellate judge is to consider Border Patrol\u2019s right to keep observers and protesters at least 150 feet from a <a href=\"http:\/\/azcapitoltimes.com\/news\/2017\/12\/05\/judges-mull-1st-amendment-restriction-at-border-checkpoint\/\">controversial checkpoint<\/a> in southern Arizona.<\/p>\n<p>Nebraska state senators and University of Nebraska officials are <a href=\"http:\/\/www.omaha.com\/news\/education\/nu-officials-nebraska-lawmakers-are-making-separate-proposals-on-free\/article_7099c8bb-53de-5593-a07a-934d8664ed2a.html\">drafting separate proposals<\/a> for new policies to referee free speech on campus.<\/p>\n<p>A federal jury rejected a professor\u2019s claim that Florida Atlantic University officials violated his constitutional rights when they fired him for stating the <a href=\"https:\/\/www.washingtonpost.com\/news\/grade-point\/wp\/2017\/12\/12\/professor-who-says-sandy-hook-was-a-hoax-sued-the-university-that-fired-him-a-jury-ruled-against-him\/?utm_term=.b201cc3e38c9\">Sandy Hook Elementary School mass shooting<\/a> was a hoax.<\/p>\n<p>A federal <a href=\"https:\/\/www.washingtonpost.com\/national\/health-science\/judge-temporarily-blocks-new-trump-rules-on-birth-control\/2017\/12\/15\/88c296d0-e1d7-11e7-b2e9-8c636f076c76_story.html?utm_term=.e1a97df32eec\">judge temporarily blocked the Trump administration<\/a> from enforcing new rules that could significantly reduce women\u2019s access to free birth control after a state attorney general claimed the new rule violated the First Amendment for promoting employer\u2019s religious beliefs over the constitutional rights of women.<\/p>\n<p>Value Village is suing Washington State Attorney General claiming that the Attorney General\u2019s office&#8217;s insistence on the <a href=\"https:\/\/www.washingtonpost.com\/business\/value-village-sues-washington-attorney-general-over-demands\/2017\/12\/12\/cb9d5c80-dfaa-11e7-b2e9-8c636f076c76_story.html?utm_term=.78f95992741c\">company disclosing<\/a> what percentage of its sales prices go to charity violates the company\u2019s free speech rights.<\/p>\n<p><!--more--><\/p>\n<p>A judge denied an <a href=\"https:\/\/www.washingtonpost.com\/national\/religion\/judge-denies-texas-churches-aid-request-in-fema-lawsuit\/2017\/12\/07\/28e50fc0-db94-11e7-a241-0848315642d0_story.html?utm_term=.d2fdcf5d0574\">emergency request for relief funds<\/a> by three Texas churches damaged during Hurricane Harvey that are suing the federal government for its treatment of houses of worship in distributing disaster aid.<\/p>\n<p>A federal lawsuit claims that a Louisiana city official violated the free-speech rights of black community leaders who were <a href=\"https:\/\/www.washingtonpost.com\/national\/lawsuit-city-stifled-black-leaders-talk-of-police-shooting\/2017\/12\/04\/2cfeb1ec-d923-11e7-a241-0848315642d0_story.html?utm_term=.1acfbb7b2e25\">removed from a public meeting<\/a> when they tried to talk about a black man\u2019s fatal shooting by police.<\/p>\n<p>Pharmaceutical companies sue to block a new California law that would require them to give <a href=\"https:\/\/www.washingtonpost.com\/business\/drug-companies-sue-to-block-california-drug-price-law\/2017\/12\/08\/53dd0fcc-dc82-11e7-a241-0848315642d0_story.html?utm_term=.8e2132b05a7f\">advance requiring a <a balance among state court judges<\/a> as unconstitutional for violating the First Amendment.<\/p>\n<p>A protestor who grabbed conservative commentator\u2019s \u201c<a The conservative commentator, Lucian Wintrich\u2019s, breach of peace charge was dropped.<\/p>\n<p>A civil rights activist, DeRay McKesson is <a href=\"https:\/\/www.washingtonpost.com\/national\/fox-news-host-jeanine-pirro-sued-for-defamation\/2017\/12\/13\/d57bf060-e06b-11e7-b2e9-8c636f076c76_story.html?utm_term=.a7c040f36665\">suing Fox News host Jeanine Pirro<\/a>, claiming she defamed him while discussing a lawsuit against Black Lives Matter.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>State Court News<\/strong><\/p>\n<p>An Iowa Supreme Court justice temporarily <a href=\"https:\/\/www.washingtonpost.com\/national\/iowa-justice-blocks-newspaper-from-reporting-court-records\/2017\/12\/15\/2a3ea45a-e1ff-11e7-b2e9-8c636f076c76_story.html?utm_term=.728d71b35269\">ordered the state\u2019s largest newspaper not to publish<\/a> the contents of court records legally obtained by one of its reporters that were inadvertently filed publicly.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Other News<\/strong><\/p>\n<p>The American Civil Liberties Union of Kansas called for a Kansas City school district to eliminate a policy prohibiting <a href=\"https:\/\/www.usnews.com\/news\/best-states\/missouri\/articles\/2017-12-09\/aclu-calls-for-kansas-school-board-to-end-complaint-ban\">public complaints<\/a> about individuals at board meetings.<\/p>\n<p>&nbsp;<\/p>\n<p><i>That\u2019s it for your First Amendment Newsflash December 4-December 17.
