\/><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Federal Court News<\/strong><\/p>\n<p>The Supreme Court will decide whether it violates the First Amendment for California to require <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/supreme-court-takes-case-on-free-speech-rights-of-antiabortion-counseling-centers\/2017\/11\/13\/cd2003f8-c882-11e7-aa96-54417592cf72_story.html?utm_term=.f6b1852d1a1e\">\u201ccrisis pregnancy centers<\/a>,\u201d which counsel patients against abortion, and instead tell patients that the state offers contraception and abortion services.<\/p>\n<p>The Supreme Court will hear a case that tests whether cops need a warrant to track individuals through <a href=\"https:\/\/www.npr.org\/2017\/11\/28\/564713772\/can-police-track-you-through-your-cellphone-without-a-warrant\">cell tower location technology<\/a>.<\/p>\n<p>The Supreme Court agreed to revisit the issue of whether five million government workers can refuse to pay union fees arguing that <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2017-09-28\/mandatory-union-fees-again-draw-u-s-supreme-court-scrutiny\">mandatory fees<\/a> violate the First Amendment.<\/p>\n<p>The Supreme Court agreed to hear a case to determine whether a Colorado cake shop owner has a First Amendment right to <a href=\"https:\/\/www.huffingtonpost.com\/entry\/masterpiece-cakeshop-wedding-cakes-the-first-amendment_us_5a21cfc5e4b05072e8b56930\">refuse to make a wedding cake<\/a> for a homosexual couple.<\/p>\n<p><!--more--><\/p>\n<p>The Supreme Court agreed to decide whether state laws that ban <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2017\/11\/13\/red-blue-supreme-court-rule-voters-apparel\/763217001\/\">political apparel at polling places<\/a> violate free speech.<\/p>\n<p>A federal appeals court <a href=\"http:\/\/www.wcvb.com\/article\/court-tosses-lawsuit-over-erotic-book-about-gronk\/13860115\">affirmed the dismissal<\/a> of an Ohio couple\u2019s suit against companies that used the couple&#8217;s engagement photos for the cover of a book about a woman\u2019s sexual desire for New England Patriots&#8217; star Rob Gronkowski.<\/p>\n<p>A <a href=\"https:\/\/www.washingtonpost.com\/national\/neo-nazi-site-founder-asks-court-to-toss-troll-storm-suit\/2017\/12\/01\/cea82688-d6bf-11e7-9ad9-ca0619edfa05_story.html?utm_term=.e5b4a3133f22\">neo-Nazi website publisher<\/a> asked a federal judge to throw out a lawsuit accusing him of orchestrating an anti-Semitic internet trolling campaign against a Montana family because the \u201ctrolling\u201d is \u201cpolitical speech.\u201d<\/p>\n<p>Federal judge <a href=\"https:\/\/www.washingtonpost.com\/news\/morning-mix\/wp\/2017\/11\/17\/federal-judge-rebukes-st-louis-police-for-tactics-used-on-protesters-after-ex-officers-acquittal\/?utm_term=.07a265c19a95\">rebukes St. Louis Police<\/a> for tactics used on protesters after ex-officer\u2019s acquittal as retaliation tactics violating the First Amendment.<\/p>\n<p>The city of Manchester <a href=\"https:\/\/www.washingtonpost.com\/national\/city-pays-275000-to-settle-lawsuit-over-filming-of-police\/2017\/11\/29\/71ba04a2-d541-11e7-9ad9-ca0619edfa05_story.html?utm_term=.a6bc7f442ce5\">paid $275,000<\/a> for violating a citizen\u2019s First Amendment right to film police.<\/p>\n<p>An organization is suing Washington Metro after the transit agency rejected its ad featuring a <a href=\"https:\/\/www.washingtonpost.com\/local\/trafficandcommuting\/is-metro-waging-war-on-christmas-archdiocese-sues-to-post-nativity-themed-bus-ads\/2017\/11\/28\/4f7a34d6-d459-11e7-b62d-d9345ced896d_story.html?utm_term=.cc212e5fde69\">biblical Christmas scene<\/a>.<\/p>\n<p>Environmental groups being sued by the developers of the Dakota pipeline asked a federal judge to <a href=\"https:\/\/www.washingtonpost.com\/national\/energy-environment\/environment-groups-want-pipeline-companys-lawsuit-dismissed\/2017\/11\/29\/c9c02006-d545-11e7-9ad9-ca0619edfa05_story.html?utm_term=.97222f665a4d\">dismiss the suit<\/a> arguing that the developer\u2019s arguments that the environmental groups disseminated false and misleading information is baseless and an attack on free speech.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>State Court News<\/strong><\/p>\n<p>The Supreme Court of Hawaii will hear a case to determine whether there is a First amendment <a href=\"http:\/\/www.kitv.com\/story\/36811578\/first-amendment-right-to-record-video-of-police-officers-at-work-at-the-center-of-a-court-case#.Wg8H_yrtVlk.twitter\">right to record police officers<\/a> at work.<\/p>\n<p>Pennsylvania\u2019s Supreme Court weighed whether <a href=\"https:\/\/www.washingtonpost.com\/national\/justices-take-up-free-speech-case-of-anti-police-rap-lyrics\/2017\/11\/28\/26bc6668-d3fa-11e7-9ad9-ca0619edfa05_story.html?utm_term=.563ecd1b11bd\">anti-police rap lyrics<\/a> constitute a \u201ctrue threat.\u201d<\/p>\n<p>Wisconsin Supreme court affirmed a <a href=\"https:\/\/www.jsonline.com\/story\/news\/crime\/2017\/12\/01\/high-court-affirms-moms-conviction-swearing-son-without-deciding-first-amendment-issue\/912787001\/\">mother\u2019s conviction for swearing at her son<\/a> without reaching the issue of whether the First Amendment protected her speech.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>State Legislative News<\/strong><\/p>\n<p>An Arizona lawmaker <a href=\"http:\/\/tucson.com\/news\/local\/arizona-lawmaker-would-outlaw-masks-costumes-at-political-demonstrations\/article_702ef5fa-1c16-5a90-af00-9afbd555a373.html\">proposed new legislation<\/a> that would make it a felony to wear any sort of disguise to evade recognition or identification at civil protests, political events, or any public event.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Other News and Commentary<\/strong><\/p>\n<p>Charlottesville\u2019s police department was criticized in an\u00a0<a href=\"https:\/\/www.washingtonpost.com\/local\/charlottesville-response-to-white-supremacist-rally-sharply-criticized-in-new-report\/2017\/12\/01\/9c59fe98-d6a3-11e7-a986-d0a9770d9a3e_story.html?utm_term=.f98455974d0f\">independent review commissioned by the city<\/a> as \u201cill-prepared\u201d and \u201clacking proper training\u201d to protect the protestors\u2019 First Amendment rights.<\/p>\n<p>A Chicago cop has been <a href=\"https:\/\/www.washingtonpost.com\/national\/chicago-cop-cited-for-racist-and-threatening-facebook-posts\/2017\/11\/22\/86844270-cfcf-11e7-a87b-47f14b73162a_story.html?utm_term=.6e5f01629aa1\">cited for racist and threatening Facebook posts<\/a>.<\/p>\n<p>Tufts University <a href=\"http:\/\/wapo.st\/2hWcFTY?tid=ss_mail&amp;utm_term=.af3735472bd4\">postponed an event<\/a> with Anthony Scaramucci, former White House communications director, after Scaramucci threatened to sue the student newspaper for publishing an opinion piece.<\/p>\n<p>Slate magazine writer claims that Trump\u2019s interest in blocking the <a href=\"http:\/\/www.slate.com\/articles\/news_and_politics\/jurisprudence\/2017\/11\/the_first_amendment_case_for_the_at_t_time_warner_merger.html\">AT&amp;T and Time Warner merger<\/a> and the Department of Justice\u2019s antitrust suit may be violating the First Amendment, depending on the DOJ\u2019s motives for blocking the
