The suit alleged that the college retaliated against students when they complained about being subjected to <\/span><a href=\"http:\/\/www.orlandosentinel.com\/business\/brinkmann-on-business\/os-bz-valencia-ultrasound-settlement-20171102-story.html\"><span style=\"font-weight:400\">required trans-vaginal ultrasounds<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight:400\">An immigrant seeking citizenship sued, alleging the words <\/span><a href=\"http:\/\/www.masslive.com\/news\/index.ssf\/2017\/11\/woman_sues_to_remove_so_help_y.html\"><span style=\"font-weight:400\">\u201cso help me God\u201d in the citizenship oath<\/span><\/a><span style=\"font-weight:400\"> violates the establishment clause.<\/span><\/p>\n<p><span style=\"font-weight:400\">A woman who alleges Bill Cosby raped her has asked the First Circuit to hear her <\/span><a href=\"http:\/\/www.detroitnews.com\/story\/news\/nation\/2017\/11\/03\/bill-cosby-defamation-lawsuit\/107301942\/\"><span style=\"font-weight:400\">defamation case against Cosby<\/span><\/a><span style=\"font-weight:400\"> en banc, after a three-judge panel cited First Amendment concerns and dismissed the case last month.<\/span><\/p>\n<p><span style=\"font-weight:400\">A real estate developer has claimed that town officials retaliated against him in violation of the First Amendment for <\/span><a href=\"https:\/\/westfaironline.com\/95783\/judge-rules-lawsuit-may-continue-mayor-richard-thomas\/\"><span style=\"font-weight:400\">speaking with the media about a dispute<\/span><\/a><span style=\"font-weight:400\"> regarding building consultants.<\/span><\/p>\n<p><span style=\"font-weight:400\">A <\/span><a href=\"http:\/\/fortune.com\/2017\/11\/03\/google-canada-censorship\/\"><span style=\"font-weight:400\">U.S. court has partially blocked a Canadian court\u2019s order<\/span><\/a><span style=\"font-weight:400\"> requiring Google to delete some search results.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Fifth Circuit heard arguments regarding the <\/span><a href=\"http:\/\/www.nola.com\/politics\/index.ssf\/2017\/11\/lawyers_for_texas_cities_argue.html\"><span style=\"font-weight:400\">First Amendment challenge to the Texas sanctuary city law<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A prison instructor sued the Delaware Department of Education, alleging his employment was terminated after he <\/span><a href=\"https:\/\/www.washingtonpost.com\/national\/prison-instructor-says-he-was-fired-for-talking-about-riot\/2017\/11\/06\/2a62f172-c349-11e7-9922-4151f5ca6168_story.html?utm_term=.64e1b46428bf\"><span style=\"font-weight:400\">spoke to the media about a prison riot<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Oregon State Board of Examiners for Engineering and Land Surveying has filed a proposed judgment in the case alleging the Board\u2019s <\/span><a href=\"https:\/\/motherboard.vice.com\/en_us\/article\/qv3ebq\/oregon-doesnt-want-to-give-up-the-power-to-fine-people-for-saying-i-am-an-engineer\"><span style=\"font-weight:400\">definition of \u201cengineer\u201d violates the First Amendment<\/span><\/a><span style=\"font-weight:400\">. In the proposed judgment, the Board admits it violated the First Amendment rights of the plaintiff, but argues the definition is not facially invalid.<\/span><\/p>\n<p><span style=\"font-weight:400\">A Fresno State University professor was ordered to pay $17,000 after he <\/span><a href=\"http:\/\/www.fresnobee.com\/news\/local\/education\/article183731526.html\"><span style=\"font-weight:400\">erased students\u2019 anti-abortion messages<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">In the campus speech case that featured a <\/span><a href=\"https:\/\/www.usnews.com\/news\/best-states\/michigan\/articles\/2017-11-09\/michigan-school-settles-case-over-expressive-activity-policy\"><span style=\"font-weight:400\">student dressed as a T-rex<\/span><\/a><span style=\"font-weight:400\"> who was not allowed to distribute literature outside of the college\u2019s free speech zone, the college has settled.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>State Court News<\/b><\/p>\n<p><span style=\"font-weight:400\">The Indiana Court of Appeals ruled in favor of Purdue University at Calumet in a First Amendment challenge brought by a professor <\/span><a href=\"https:\/\/www.insidehighered.com\/news\/2017\/11\/06\/indiana-appeals-court-sides-purdue-calumet-professors-free-speech-case\"><span style=\"font-weight:400\">against the university\u2019s anti-harassment policies<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A Washington State court has upheld the state\u2019s tax-funded <\/span><a href=\"https:\/\/www.courthousenews.com\/political-spending-voucher-program-upheld-seattle\/\"><span style=\"font-weight:400\">political \u201cdemocracy voucher\u201d<\/span><\/a><span style=\"font-weight:400\"> program as constitutional.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Pennsylvania Supreme Court decided that <\/span><a href=\"https:\/\/billypenn.com\/2017\/11\/07\/chestnut-hill-college-to-stop-court-battle-face-discrimination-charge\/\"><span style=\"font-weight:400\">a private college does not have a First Amendment right<\/span><\/a><span style=\"font-weight:400\"> to immunity from the state\u2019s anti-discrimination laws.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Other News &amp; Commentary<\/b><\/p>\n<p><span style=\"font-weight:400\">A Cato Institute <\/span><a href=\"https:\/\/www.cato.org\/survey-reports\/state-free-speech-tolerance-america\"><span style=\"font-weight:400\">study on free speech in America<\/span><\/a><span style=\"font-weight:400\"> shows that 71% of Americans believe concerns about political correctness have hindered conversations about social issues.<\/span><\/p>\n<p><span style=\"font-weight:400\">The property manager for a federal building has <\/span><a href=\"https:\/\/www.washingtonpost.com\/local\/federal-building-in-dc-rejects-richard-spencers-request-to-host-conference\/2017\/11\/02\/a64b27ca-bfdc-11e7-959c-fe2b598d8c00_story.html?utm_term=.fe40429d63b7\"><span style=\"font-weight:400\">rejected a request by Richard Spencer<\/span><\/a><span style=\"font-weight:400\"> to host a conference in the building.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><i><span style=\"font-weight:400\">That\u2019s it for your First Amendment Newsflash Oct. 30-November 12.
