Becerra<\/span><\/i><\/a><span style=\"font-weight:400\">, <\/span><a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/livingwell-medical-clinic-inc-v-becerra\/\"><i><span style=\"font-weight:400\">Livingwell Medical Clinic, Inc. v. Becerra<\/span><\/i><\/a><span style=\"font-weight:400\">, <\/span><a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/minnesota-voters-alliance-v-mansky\/\"><i><span style=\"font-weight:400\">Minnesota Voters Alliance v. Mansky<\/span><\/i><\/a><span style=\"font-weight:400\">, and <\/span><a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/national-institute-family-life-advocates-v-becerra\/\"><i><span style=\"font-weight:400\">National Institute of Family and Life Advocates v. Becerra<\/span><\/i><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Connecticut has filed a petition for writ of certiorari in the case of a <\/span><a href=\"http:\/\/www.courant.com\/news\/connecticut\/hc-news-scotus-abusive-language-20171023-story.html\"><span style=\"font-weight:400\">woman convicted of breaching the peace for using foul language toward a grocery store manager<\/span><\/a><span style=\"font-weight:400\">. The state Supreme Court overturned the woman\u2019s conviction on First Amendment grounds, and the State <\/span><a href=\"http:\/\/www.scotusblog.com\/wp-content\/uploads\/2017\/10\/17-464-petition.pdf\"><span style=\"font-weight:400\">now asks the U.S. Supreme Court<\/span><\/a><span style=\"font-weight:400\"> to consider whether the conviction can be reinstated under the fighting words doctrine.<\/span><br \/>\n<b>Other Federal Court News<\/b><\/p>\n<p><span style=\"font-weight:400\">In a former prosecutor\u2019s First Amendment lawsuit against the Baltimore State\u2019s Attorney for firing her for political reasons, the Fourth Circuit ruled that <\/span><a href=\"http:\/\/www.baltimoresun.com\/news\/maryland\/crime\/bs-md-ci-mosby-wins-appeal-20171017-story.html\"><span style=\"font-weight:400\">elected prosecutors may legally terminate the employment of assistant prosecutors<\/span><\/a><span style=\"font-weight:400\"> for political reasons.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal judge ruled in a defamation suit that Greenpeace\u2019s statements against a logging company were <\/span><a href=\"https:\/\/www.courthousenews.com\/judge-fells-loggers-rico-lawsuit-greenpeace\/\"><span style=\"font-weight:400\">First Amendment-protected opinion statements<\/span><\/a><span style=\"font-weight:400\">, and thus the case was dismissed.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Fourth Circuit ruled that a <\/span><a href=\"https:\/\/www.washingtontimes.com\/news\/2017\/oct\/18\/peace-cross-of-bladensburg-ruled-unconstitutional-\/\"><span style=\"font-weight:400\">40-foot tall, cross-shaped WWI memorial<\/span><\/a><span style=\"font-weight:400\"> in Bladensburg, Maryland violates the establishment clause.<\/span><\/p>\n<p><span style=\"font-weight:400\">The 2009 Christmas underwear bomber has <\/span><a href=\"http:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2017\/10\/23\/umar-farouk-abdulmutallab-underwear-bomber-lawsuit\/106924938\/\"><span style=\"font-weight:400\">sued the Federal Bureau of Prisons<\/span><\/a><span style=\"font-weight:400\">, alleging that his First Amendment right to free exercise has been violated by guards harassing him during prayer time and denying him the ability to engage in congregational prayer. He also argues that his right to freedom of speech has been violated by restrictions placed on his communications.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal judge ruled that a Kentucky law <\/span><a href=\"https:\/\/www.usnews.com\/news\/best-states\/kentucky\/articles\/2017-10-20\/judge-strikes-down-internet-restrictions-for-sex-offenders\"><span style=\"font-weight:400\">restricting sex offenders\u2019 access to the internet<\/span><\/a><span style=\"font-weight:400\"> violates the First Amendment because it \u201cb<\/span><span style=\"font-weight:400\">urdens substantially more speech than necessary\u201d to further the state\u2019s interest. For an analysis of this issue in general, see FALR staff member Joscelyn Solomon\u2019s recent blog post <\/span><a href=\"https:\/\/journals.law.unc.edu\/firstamendmentlawreview\/2017\/10\/18\/protecting-children-from-sexual-abuse-or-suppressing-free-speech-packingham-v-north-carolina\/\"><span style=\"font-weight:400\">here<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A Pennsylvania woman has sued her township, alleging that ordinances <\/span><a href=\"http:\/\/www.goerie.com\/news\/20171022\/millcreek-woman-sues-over-political-yard-signs\"><span style=\"font-weight:400\">restricting the number of temporary signs<\/span><\/a><span style=\"font-weight:400\">&#8211;including political signs&#8211;allowed in resident yards is unconstitutional. The township has voluntarily <\/span><a href=\"http:\/\/www.goerie.com\/news\/20171025\/millcreek-temporarily-suspends-yard-sign-rule\"><span style=\"font-weight:400\">temporarily stopped enforcing the ordinance<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight:400\">A local chapter of the United Daughters of the Confederacy has sued a Louisiana parish on First Amendment grounds after the <\/span><a href=\"https:\/\/www.usatoday.com\/story\/news\/nation-now\/2017\/10\/20\/suit-seeks-block-illegal-removal-confederate-monument-louisiana\/786714001\/\"><span style=\"font-weight:400\">parish voted to remove a confederate monument from courthouse grounds<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The former Utah Attorney General has argued a free speech defense in a legal action in which the <\/span><a href=\"https:\/\/www.ksl.com\/?nid=148&amp;sid=46185875\"><span style=\"font-weight:400\">FEC alleges he engaged in illegal campaign finance actions<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A nonprofit educational organization and YouTube channel has <\/span><a href=\"https:\/\/www.law.com\/therecorder\/sites\/therecorder\/2017\/10\/24\/youtube-accused-of-discriminating-against-conservative-videos\/\"><span style=\"font-weight:400\">sued YouTube and Google for violating its First Amendment rights<\/span><\/a><span style=\"font-weight:400\"> by inappropriately placing age restrictions on videos. The <\/span><a href=\"http:\/\/www.bgrfirm.com\/wp-content\/uploads\/2017\/10\/PRAGER_U-_v_GOOGLE-YOUTUBE_complaint_10-23-2017_FILED.pdf\"><span style=\"font-weight:400\">complaint<\/span><\/a><span style=\"font-weight:400\"> alleges that Google has \u201ch[e]ld YouTube out to the public as a forum intended to defend and protect free speech where members of the general public may speak, express, and exchange their ideas.\u201d<\/span><\/p>\n<p><span style=\"font-weight:400\">Charges against <\/span><a href=\"http:\/\/www.cleveland.com\/court-justice\/index.ssf\/2017\/10\/charges_dropped_against_protes_1.html\"><span style=\"font-weight:400\">Republican National Convention protesters who were arrested during a flag burning<\/span><\/a><span style=\"font-weight:400\"> at the convention in 2016 were dismissed.<\/span><\/p>\n<p><span style=\"font-weight:400\">A firm involved in a dossier that alleged the Trump campaign worked with Russians to influence the U.S. election has <\/span><a href=\"https:\/\/www.thepenn.org\/news\/firm-tied-to-trump-dossier-tries-to-block-house-panel\/article_b4babb2a-b859-11e7-ae80-138e58e291a1.html\"><span style=\"font-weight:400\">filed a complaint to prevent its bank from disclosing its records subject to a congressional subpoena<\/span><\/a><span style=\"font-weight:400\">, alleging that the subpoena violates its First Amendment rights.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Trump administration <\/span><a href=\"http:\/\/www.kansas.com\/news\/business\/article180969971.html\"><span style=\"font-weight:400\">has agreed to settle a class action<\/span><\/a><span style=\"font-weight:400\"> lawsuit filed by Tea Party-connected organizations that alleged they were subject to viewpoint-discriminatory hurdles when applying for tax-exempt status during the 2012 presidential campaign.<\/span><\/p>\n<p><span style=\"font-weight:400\">Trump campaign attorneys argued in an invasion of privacy suit that <\/span><a href=\"https:\/\/www.washingtontimes.com\/news\/2017\/oct\/26\/wikileaks-publishing-hacked-dnc-emails-deemed-lega\/\"><span style=\"font-weight:400\">WikiLeaks&#8217; publication of DNC emails was First Amendment-protected activity<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">In another case dealing with the social media accounts of public servants, a Florida County Clerk of Court\u2019s office faces a lawsuit alleging that it <\/span><a href=\"http:\/\/www.chipleypaper.com\/news\/20171025\/lawsuit-clerk-of-court-staff-violated-first-fourteenth-amendments\"><span style=\"font-weight:400\">deleted comments and blocked users<\/span><\/a>, which<span style=\"font-weight:400\"> violated the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">A College Republicans chapter has sued Southern Illinois University, alleging that the university\u2019s <\/span><a href=\"http:\/\/www.stltoday.com\/news\/local\/education\/notes-from-campus\/college-republicans-at-siue-file-suit-over-free-speech-space\/article_86c1b456-6166-5b36-ab76-72601c366221.html\"><span style=\"font-weight:400\">regulation of student speech outside a designated \u201cfree speech zone\u201d<\/span><\/a><span style=\"font-weight:400\"> violates the First Amendment.<\/span><br \/>\n<b>State Court News<\/b><\/p>\n<p><span style=\"font-weight:400\">Sued for defamation for alleging that an orphanage founder is a pedophile, a Maine man has asked a state judge to <\/span><a href=\"https:\/\/www.washingtonpost.com\/national\/man-who-accused-orphanage-founder-seeks-lawsuit-dismissal\/2017\/10\/20\/f1d7b108-b5ce-11e7-9b93-b97043e57a22_story.html?utm_term=.a065309bc6d9\"><span style=\"font-weight:400\">dismiss the suit under the state\u2019s anti-SLAPP provision<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A California man <\/span><a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/lawyer-asks-judge-to-toss-trespassing-charge-against-calif-man\/article_dd13312c-b1eb-5d04-9502-2a8468584c3c.html\"><span style=\"font-weight:400\">arrested for trespassing while protesting in a public square<\/span><\/a><span style=\"font-weight:400\"> during an event has asked the court to consider a First Amendment defense.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Ohio Supreme Court held that a <\/span><a href=\"http:\/\/www.dailymail.co.uk\/news\/article-5020585\/Court-Ohio-require-people-HIV-tell-sex-partners.html\"><span style=\"font-weight:400\">state law requiring disclosure of HIV status<\/span><\/a><span style=\"font-weight:400\"> does not violate the First Amendment.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Federal Legislative News<\/b><\/p>\n<p><span style=\"font-weight:400\">After Trump suggested on Twitter that NBC\u2019s license should be revoked, Senator Blumenthal wrote a letter to the chairman of the FCC asking for the commission\u2019s \u201c<\/span><a href=\"https:\/\/www.blumenthal.senate.gov\/imo\/media\/doc\/20171016%20Blumenthal%20to%20FCC%20re%20Trump%20Tweets%20on%20Revoking%20Broadcast%20Licensees%20-%20PAI.pdf\"><span style=\"font-weight:400\">unwavering commitment\u201d to free speech<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Federal Executive News<\/b><\/p>\n<p><span style=\"font-weight:400\">In response to Trump\u2019s tweet regarding media licenses, the FCC chairman stated <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/the-switch\/wp\/2017\/10\/17\/trumps-fcc-chair-has-finally-addressed-the-nbc-license-issue\/?utm_term=.70f371a94c39\"><span style=\"font-weight:400\">\u201cI believe in the First Amendment.\u201d<\/span><\/a><\/p>\n<p><span style=\"font-weight:400\">The<\/span><a href=\"http:\/\/www.chronicle.com\/article\/sessions-justice-dept-is\/241543\"><span style=\"font-weight:400\"> Department of Justice filed a statement of interest in a federal student speech lawsuit<\/span><\/a><span style=\"font-weight:400\"> against Pierce College, in which a student alleges administrators stopped him from handing out Spanish language constitutions outside the college\u2019s \u201cfree speech zone.\u201d <\/span><\/p>\n<p><span style=\"font-weight:400\">The Department of Justice <\/span><a href=\"https:\/\/www.nytimes.com\/reuters\/2017\/10\/24\/business\/24reuters-microsoft-usa.html\"><span style=\"font-weight:400\">altered its rules regarding internet service providers alerting users of agency requests to access their information<\/span><\/a><span style=\"font-weight:400\">, leading to Microsoft dropping its First Amendment suit against the Department. An Electronic Frontier Foundation analysis can be found <\/span><a href=\"https:\/\/www.eff.org\/deeplinks\/2017\/10\/new-doj-policy-gag-orders-good-courts-could-have-done-better\"><span style=\"font-weight:400\">here<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The DOJ also asked the Supreme Court for <\/span><a href=\"https:\/\/townhall.com\/tipsheet\/laurettabrown\/2017\/10\/26\/trump-administration-asks-to-argue-before-supreme-court-on-behalf-of-christian-baker-n2400875\"><span style=\"font-weight:400\">permission to speak during oral arguments<\/span><\/a><span style=\"font-weight:400\"> in <\/span><i><span style=\"font-weight:400\">Masterpiece Cakes<\/span><\/i><span style=\"font-weight:400\">, the case that pits anti-discrimination laws against First Amendment rights to free exercise and free speech.<\/span><\/p>\n<p><span style=\"font-weight:400\">The FCC will vote to <\/span><a href=\"http:\/\/thehill.com\/policy\/technology\/357172-fcc-to-vote-on-rolling-back-media-ownership-rules\"><span style=\"font-weight:400\">stop prohibiting common ownership<\/span><\/a><span style=\"font-weight:400\"> of newspapers and broadcast stations in the same area.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>State Legislative News<\/b><\/p>\n<p><span style=\"font-weight:400\">In an apparent protest of gun ownership licensure, an Indiana lawmaker has broadened his proposal to license the press by <\/span><a href=\"https:\/\/www.indystar.com\/story\/news\/politics\/2017\/10\/16\/indiana-lawmaker-double-downs-hi-proposal-license-journalists-gets-cold-reception-but-he-doubles-dow\/762810001\/\"><span style=\"font-weight:400\">proposing to also license free speech<\/span><\/a><span style=\"font-weight:400\">, religious freedom, and other rights.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Other News &amp; Commentary<\/b><\/p>\n<p><span style=\"font-weight:400\">Yale Law professor and former dean Robert C. Post wrote for Vox that the <\/span><a href=\"https:\/\/www.vox.com\/the-big-idea\/2017\/10\/25\/16526442\/first-amendment-college-campuses-milo-spencer-protests\"><span style=\"font-weight:400\">First Amendment does not apply on public college campuses<\/span><\/a><span style=\"font-weight:400\">. In a response, also for Vox, Berkeley Law dean Erwin Chemerinsky argues that students enjoy <\/span><a href=\"https:\/\/www.vox.com\/the-big-idea\/2017\/10\/25\/16524832\/campus-free-speech-first-amendment-protest\"><span style=\"font-weight:400\">robust First Amendment protections on campus<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Joe Biden participated in an event at the University of Delaware and <\/span><a href=\"http:\/\/www.washingtonexaminer.com\/joe-biden-urges-the-left-to-respect-free-speech-liberals-have-very-short-memories\/article\/2638031\"><span style=\"font-weight:400\">encouraged liberals to stand up for free speech<\/span><\/a><span style=\"font-weight:400\">, referencing the historical liberal fight for free expression.<\/span><\/p>\n<p><span style=\"font-weight:400\">The New York Times published a discussion of the <\/span><a href=\"https:\/\/www.nytimes.com\/2017\/10\/22\/arts\/design\/the-newseum-is-increasingly-relevant-but-can-it-survive.html\"><span style=\"font-weight:400\">future financial viability of the Newseum<\/span><\/a><span style=\"font-weight:400\">, a museum in Washington, D.C. that celebrates the history of journalism as well as the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">The <\/span><a href=\"http:\/\/www.miamiherald.com\/news\/local\/education\/article179680501.html\"><span style=\"font-weight:400\">University of Florida hosted controversial speaker Richard Spencer<\/span><\/a><span style=\"font-weight:400\">, an event that prompted counter-protests as well as nationwide discussions about free speech on campus. Ohio State University <\/span><a href=\"http:\/\/www.newsweek.com\/ohio-state-university-denies-white-supremacist-richard-spencer-request-speak-690108\"><span style=\"font-weight:400\">denied a request by a graduate student to have Spencer speak on campus<\/span><\/a><span style=\"font-weight:400\">, and the student has <\/span><a href=\"https:\/\/www.thelantern.com\/2017\/10\/ohio-state-sued-after-denying-white-supremacist-richard-spencer-space-to-speak\/\"><span style=\"font-weight:400\">sued the university<\/span><\/a><span style=\"font-weight:400\"> based on this denial. <\/span><a href=\"http:\/\/www.centredaily.com\/news\/local\/education\/penn-state\/article180478026.html\"><span style=\"font-weight:400\">Penn State also faces a suit<\/span><\/a><span style=\"font-weight:400\"> for denying a request for Spencer to speak on campus. The University of Cincinnati <\/span><a href=\"http:\/\/www.wlwt.com\/article\/university-of-cincinnati-condemns-hate-defends-richard-spencer-appearance\/13083545\"><span style=\"font-weight:400\">approved a request<\/span><\/a><span style=\"font-weight:400\"> for Spencer to speak.<\/span><\/p>\n<p><span style=\"font-weight:400\">The University of California announced that it will <\/span><a href=\"http:\/\/www.dailydemocrat.com\/20171027\/uc-launches-new-free-speech-center\"><span style=\"font-weight:400\">open a center in Washington, D.C. focused on the First Amendment<\/span><\/a><span style=\"font-weight:400\"> and related research.<\/span><\/p>\n<p><span style=\"font-weight:400\">The <\/span><a href=\"http:\/\/www.reuters.com\/article\/us-un-usa-trump\/u-n-rights-expert-assails-trump-administration-on-press-treatment-idUSKBN1CU2PL\"><span style=\"font-weight:400\">United Nations Special Rapporteur on freedom of opinion and expression<\/span><\/a><span style=\"font-weight:400\"> expressed concern over the Trump administration\u2019s dealings with the press.<\/span><\/p>\n<p>And finally, the First Amendment Law Review hosted its long-awaited symposium:\u00a0<em><a href=\"https:\/\/journals.law.unc.edu\/firstamendmentlawreview\/symposium\/\">Distorting the Truth: &#8220;Fake News&#8221; and Free Speech<\/a>\u00a0<\/em>on Friday, October 27.
