\/><\/p>\n<p>&nbsp;<\/p>\n<p><em><b>Court News<\/b><\/em><\/p>\n<p><span style=\"font-weight:400\">A federal magistrate judge ruled that a<\/span><a href=\"http:\/\/www.nbcchicago.com\/news\/local\/Homeless-Chicagoans-Being-Forced-Out-of-Tents-But-Some-Refuse-to-Leave-445323073.html\"> <span style=\"font-weight:400\">homeless encampment in Chicago<\/span><\/a><span style=\"font-weight:400\"> did not qualify as a First Amendment-protected statement.<\/span><\/p>\n<p><span style=\"font-weight:400\">A panel of the 9th Circuit asked for amicus briefs considering whether a federal law<\/span><a href=\"http:\/\/www.politico.com\/blogs\/under-the-radar\/2017\/09\/19\/illegal-immigration-first-amendment-242868\"> <span style=\"font-weight:400\">criminalizing encouraging or inducing illegal immigration<\/span><\/a><span style=\"font-weight:400\"> violates the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">The 9th Circuit granted a preliminary injunction against San Francisco\u2019s ordinance requiring<\/span><a href=\"http:\/\/www.sfexaminer.com\/appeals-court-orders-injunction-blocking-sf-soda-warning-law\/\"> <span style=\"font-weight:400\">health warnings on sugary drinks<\/span><\/a><span style=\"font-weight:400\">, such as pop.<\/span><\/p>\n<p><span style=\"font-weight:400\">A school lunch aide accused of<\/span><a href=\"http:\/\/www.scotusblog.com\/wp-content\/uploads\/2017\/09\/17-209-cert-rb.pdf\"> <span style=\"font-weight:400\">illegally sexting a student<\/span><\/a><span style=\"font-weight:400\"> has filed a writ of certiorari with the Supreme Court, arguing that the statute under which she was charged is unconstitutionally broad.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal judge dismissed two videographers\u2019<\/span><a href=\"http:\/\/wtop.com\/business-finance\/2017\/09\/judge-rejects-couples-argument-for-refusing-gay-customers\/\"> <span style=\"font-weight:400\">religious freedom lawsuit<\/span><\/a><span style=\"font-weight:400\"> challenging the Minnesota Human Rights Act, which barred the videographers from denying services for same-sex weddings.<\/span><\/p>\n<p>HBO has asked a West Virginia state court to dismiss coal baron<a href=\"http:\/\/www.hollywoodreporter.com\/thr-esq\/hbo-john-oliver-ask-west-virginia-judge-dismiss-defamation-lawsuit-1041867\"> Robert Murray\u2019s defamation lawsuit involving the John Oliver show<\/a>.<\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight:400\">A Kansas inmate has sued the Topeka Correctional Facility, alleging that the<\/span><a href=\"http:\/\/www.newsweek.com\/kansas-prison-inmate-says-christian-propaganda-violates-constitution-668673\"> <span style=\"font-weight:400\">prison violates the Establishment Clause<\/span><\/a><span style=\"font-weight:400\"> by \u201cimposing strong Christian values on inmates.\u201d<\/span><\/p>\n<p><span style=\"font-weight:400\">A<\/span><a href=\"http:\/\/www.chicagotribune.com\/business\/ct-flushable-wipes-labeling-lawsuit-20170920-story.html\"> <span style=\"font-weight:400\">flushable wipe manufacturer<\/span><\/a><span style=\"font-weight:400\"> is alleging the District of Columbia law regulating labeling of such wipes as \u201cflushable\u201d violates the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">A Wisconsin mother convicted of disorderly conduct<\/span><a href=\"http:\/\/www.jsonline.com\/story\/news\/blogs\/proof-and-hearsay\/2017\/09\/20\/wisconsin-mothers-profanity-toward-her-son-crime-free-speech\/684603001\/\"> <span style=\"font-weight:400\">for yelling profanity at her son<\/span><\/a><span style=\"font-weight:400\"> after he burned some popcorn is arguing before the Wisconsin Supreme Court that her conviction violates her free speech right to use profanity.<\/span><\/p>\n<p><span style=\"font-weight:400\">A lawsuit challenging North Carolina\u2019s<\/span><a href=\"http:\/\/www.abajournal.com\/news\/article\/federal_judge_tosses_challenge_to_statute_banning_unauthorized_practice_of\"> <span style=\"font-weight:400\">unauthorized practice of law<\/span><\/a><span style=\"font-weight:400\"> statute on First Amendment grounds was dismissed by a federal judge.<\/span><\/p>\n<p><span style=\"font-weight:400\">A group of news organizations that sued the state of Arizona arguing that the First Amendment required the state<\/span><a href=\"http:\/\/www.newsobserver.com\/news\/article174645196.html\"> <span style=\"font-weight:400\">reveal its sources for execution drugs<\/span><\/a><span style=\"font-weight:400\"> has lost its case.<\/span><\/p>\n<p><span style=\"font-weight:400\">The ACLU has sued<\/span><a href=\"https:\/\/mic.com\/articles\/184670\/missouri-aclu-sues-st-louis-over-police-tactics-used-on-protesters-after-jason-stockleys-acquittal#.vqp9Pgngu\"> <span style=\"font-weight:400\">St. Louis for violating protesters\u2019 First Amendment rights<\/span><\/a><span style=\"font-weight:400\"> when police used \u201ckettling\u201d to control the crowd and seized protesters\u2019 cell phones and deleted videos.<\/span><\/p>\n<p><span style=\"font-weight:400\">In a lawsuit alleging that Beyonce illegally used rapper Anthony Barre\u2019s voice in her song \u201cFormation,\u201d<\/span><a href=\"http:\/\/wgno.com\/2017\/09\/22\/beyonces-lawyers-say-it-was-reasonable-and-justified-to-use-messy-myas-voice-in-formation\/\"> <span style=\"font-weight:400\">Beyonce is arguing that the First Amendment protects this use<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Russian entrepreneur Aleksej Gurbarev, who was implicated in the Trump Dossier published by BuzzFeed and at issue in a recent defamation case, is arguing that the<\/span><a href=\"http:\/\/www.hollywoodreporter.com\/thr-esq\/russian-executive-argues-trump-dossier-sources-not-shielded-by-first-amendment-1043540\"> <span style=\"font-weight:400\">First Amendment should not shield revelation of anonymous sources of the dossier<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">In a suit challenging an<\/span><a href=\"https:\/\/www.arktimes.com\/ArkansasBlog\/archives\/2017\/09\/27\/judge-enjoins-new-anti-begging-law-as-unconstitutional\"> <span style=\"font-weight:400\">Arkansas panhandling law<\/span><\/a><span style=\"font-weight:400\">, a federal judge has ruled that the law violates the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Supreme Court has announced that it will hear a case considering whether<\/span><a href=\"http:\/\/www.cnn.com\/2017\/09\/28\/politics\/supreme-court-union-fee\/index.html\"> <span style=\"font-weight:400\">public sector unions<\/span><\/a><span style=\"font-weight:400\"> can require non-members to pay \u201cfair share\u201d fees, used to facilitate collective bargaining.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal judge has granted a preliminary injunction blocking West Virginia\u2019s<\/span><a href=\"https:\/\/www.forbes.com\/sites\/georgeleef\/2017\/09\/28\/judge-blocks-enforcement-of-right-to-work-in-west-virginia-supreme-court-thrashes-her-ruling\/#5693b84a7978\"> <span style=\"font-weight:400\">Right to Work law<\/span><\/a><span style=\"font-weight:400\"> because the law likely violates union workers\u2019 right to assembly and association.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><em><b>Federal Executive News<\/b><\/em><\/p>\n<p><span style=\"font-weight:400\">The FDA is beginning an initiative to find ways to require<\/span><a href=\"http:\/\/thehill.com\/regulation\/healthcare\/351171-fda-to-study-warnings-for-cigarette-packaging\"> <span style=\"font-weight:400\">cigarette warning labels<\/span><\/a><span style=\"font-weight:400\"> that do not run afoul of the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Department of Justice filed a statement of interest in the case of Chike Uzuegbunam, a George Gwinnett College<\/span><a href=\"http:\/\/www.ajc.com\/news\/local-education\/feds-say-georgia-college-violated-student-constitutional-rights\/AM6EL4kUDIo5WnaOZ6noPP\/\"> <span style=\"font-weight:400\">student suing his college<\/span><\/a><span style=\"font-weight:400\"> for disallowing him from distributing fliers outside the college\u2019s \u201cfree speech zones.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><em><b>Other News &amp; Commentary<\/b><\/em><\/p>\n<p><span style=\"font-weight:400\">Middle Tennessee State University has launched an online<\/span><a href=\"https:\/\/mtsu.edu\/first-amendment\/\"> <span style=\"font-weight:400\">First Amendment Encyclopedia<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A<\/span><a href=\"https:\/\/www.brookings.edu\/blog\/fixgov\/2017\/09\/18\/views-among-college-students-regarding-the-first-amendment-results-from-a-new-survey\/\"> <span style=\"font-weight:400\">Brookings Institute survey<\/span><\/a><span style=\"font-weight:400\"> of college students suggested that nearly 20% of college students believe it is acceptable to use violence to prevent a speaker from speaking. The methods used by this survey, however, have been questioned and some polling experts have called the survey \u201c<\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2017\/sep\/22\/college-free-speech-violence-survey-junk-science\"><span style=\"font-weight:400\">junk science<\/span><\/a><span style=\"font-weight:400\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight:400\">A free speech controversy has erupted after NFL players<\/span><a href=\"https:\/\/www.washingtonpost.com\/opinions\/what-the-nfl-take-a-knee-protests-mean\/2017\/09\/26\/4915930e-a210-11e7-b573-8ec86cdfe1ed_story.html?utm_term=.497c5f5490c0\"> <span style=\"font-weight:400\">knelt during the national anthem<\/span><\/a><span style=\"font-weight:400\"> in protest of police brutality and racism in America.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Knight First Amendment Institute published Tim Wu\u2019s analysis on<\/span><a href=\"https:\/\/knightcolumbia.org\/content\/tim-wu-first-amendment-obsolete\"> <span style=\"font-weight:400\">whether the First Amendment remains relevant<\/span><\/a><span style=\"font-weight:400\"> in the current political and cultural climate.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><i><span style=\"font-weight:400\">That\u2019s it for your First Amendment Newsflash Sept. 18-Oct. 1.
