federal court on First Amendment grounds for <\/span><a href=\"https:\/\/www.insidehighered.com\/quicktakes\/2017\/09\/05\/richard-spencer%E2%80%99s-group-sues-michigan-state-u\"><span style=\"font-weight:400\">denying rental space for Richard Spencer to speak<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">An Ohio man convicted of failing to tell his sexual partner that he is HIV-positive is arguing before the Ohio Supreme Court that the state law requiring <\/span><a href=\"https:\/\/www.nbcnews.com\/feature\/nbc-out\/court-weighs-first-amendment-challenge-ohio-hiv-assault-law-n798576\"><span style=\"font-weight:400\">HIV disclosure violates his First Amendment rights<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Alabama Supreme Court Justice Tom Parker argued in federal court that some <\/span><a href=\"http:\/\/www.al.com\/news\/index.ssf\/2017\/09\/federal_judge_allows_justice_t.html\"><span style=\"font-weight:400\">restrictions on judges\u2019 speech violate the First Amendment<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Three Texas churches have <\/span><a href=\"https:\/\/www.reuters.com\/article\/us-storm-harvey-churches-lawsuit\/texas-churches-sue-fema-for-disaster-relief-after-harvey-idUSKCN1BG2QV\"><span style=\"font-weight:400\">sued FEMA for allegedly discriminating based on religion<\/span><\/a><span style=\"font-weight:400\"> in its provision of disaster relief.<\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight:400\">The North Carolina Court of Appeals ruled that the state\u2019s <\/span><a href=\"http:\/\/www.journalnow.com\/news\/local\/alienation-of-affection-law-upheld-in-forsyth-county-case\/article_39954488-60c1-5692-ba62-8fd93c71ea2b.html\"><span style=\"font-weight:400\">alienation of affection law<\/span><\/a><span style=\"font-weight:400\">&#8211;which allows individuals to collect damages from their spouses\u2019 lovers&#8211;does not violate the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">Courthouse News has appealed to the Ninth Circuit on two cases involving <\/span><a href=\"https:\/\/www.courthousenews.com\/stage-set-9th-circuit-clear-first-amendment-conflict-press-access\/\"><span style=\"font-weight:400\">press access to court documents<\/span><\/a><span style=\"font-weight:400\"> before the documents are processed and docketed.<\/span><\/p>\n<p><span style=\"font-weight:400\">A judge has <\/span><a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/judge-declines-to-halt-radio-ads-critical-of-dunn\/article_e8defa71-2362-59ef-a97a-61e268b35edd.html\"><span style=\"font-weight:400\">denied issuance of an injunction<\/span><\/a><span style=\"font-weight:400\"> in the case of a New Mexico politician who sued his competitor for defamation in response to radio advertisements.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Sixth Circuit, sitting en banc, ruled that <\/span><a href=\"https:\/\/www.courthousenews.com\/split-en-banc-sixth-circuit-oks-government-led-prayer\/\"><span style=\"font-weight:400\">a Michigan county can continue to open meetings with prayers<\/span><\/a><span style=\"font-weight:400\">, citing tradition and the non-coercive nature of the practice.<\/span><\/p>\n<p><span style=\"font-weight:400\">The lawyer who represented Hulk Hogan in his suit against Gawker is now representing a plaintiff in a <\/span><a href=\"http:\/\/nypost.com\/2017\/09\/07\/hulk-hogans-lawyer-sets-sights-on-new-target-jezebel\/amp\/\"><span style=\"font-weight:400\">defamation suit against Jezebel<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><a href=\"http:\/\/www.abajournal.com\/news\/article\/claimed_email_inventor_loses_defamation_suit_against_techdirt\"><span style=\"font-weight:400\">TechDirt won its motion to dismiss<\/span><\/a><span style=\"font-weight:400\"> in the defamation case in which a claimed email inventor sued the media company for calling him a liar.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Satanic Temple has sued claiming that <\/span><a href=\"https:\/\/psmag.com\/news\/pro-lifers-meet-your-worst-enemy-satan\"><span style=\"font-weight:400\">Missouri\u2019s abortion consent law violates <\/span><\/a><span style=\"font-weight:400\">free exercise rights.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal judge ruled that Manchester, New Hampshire\u2019s <\/span><a href=\"http:\/\/www.calgarysun.com\/2017\/09\/08\/anti-panhandling-by-laws-violate-first-amendment-judge-rules\"><span style=\"font-weight:400\">panhandling ordinances<\/span><\/a><span style=\"font-weight:400\"> violated the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Tenth Circuit ruled that <\/span><a href=\"https:\/\/www.courthousenews.com\/tenth-circuit-wont-give-wyomings-ag-gag-law-free-pass\/\"><span style=\"font-weight:400\">Wyoming\u2019s ag-gag law<\/span><\/a><span style=\"font-weight:400\"> may unconstitutionally violate free speech rights.<\/span><\/p>\n<p><a href=\"http:\/\/www.thestranger.com\/slog\/2017\/09\/11\/25407578\/what-is-anal-cleft-the-bikini-baristas-suing-the-city-of-everett-are-wondering-too\"><span style=\"font-weight:400\">Bikini baristas<\/span><\/a><span style=\"font-weight:400\"> have sued Everett, Washington, over a new city ordinance that directs baristas to cover certain parts of their bodies while working.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Minnesota Supreme Court invalidated a state law that <\/span><a href=\"http:\/\/www.brainerddispatch.com\/news\/4327585-local-activist-wins-free-speech-case-state-supreme-court\"><span style=\"font-weight:400\">criminalized disrupting public meetings<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Washington State Supreme Court ruled that a child who texted pictures of his genitals to a woman can face consequences under <\/span><a href=\"http:\/\/www.spokesman.com\/stories\/2017\/sep\/14\/child-porn-conviction-upheld-in-youth-sexting-case\/\"><span style=\"font-weight:400\">state child pornography laws<\/span><\/a><span style=\"font-weight:400\">, despite the child\u2019s arguments that such conviction would violate his First Amendment rights.<\/span><\/p>\n<p><span style=\"font-weight:400\">A D.C. Superior Court judge has denied several motions to dismiss related to <\/span><a href=\"http:\/\/wtop.com\/dc\/2017\/09\/judge-denies-motions-dismiss-alleged-inauguration-day-protesters-cases\/?preview_id=15656951\"><span style=\"font-weight:400\">Inauguration Day protesters charged with felony rioting<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Several American citizens have filed a lawsuit alleging that their First and Fourteenth Amendment rights were violated when <\/span><a href=\"http:\/\/gizmodo.com\/i-was-in-severe-pain-lawsuit-alleges-illegal-electro-1806528281\"><span style=\"font-weight:400\">Border Patrol seized their phones and computers<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">Former hedge fund manager <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/business\/wp\/2017\/09\/13\/martin-shkreli-apologizes-for-facebook-post-about-hillary-clinton\/?utm_term=.0a7b4790707b\"><span style=\"font-weight:400\">Martin Shkreli has had his bail revoked after he posted<\/span><\/a><span style=\"font-weight:400\"> on Facebook offering $5,000 for a strand of Hillary Clinton\u2019s hair. He argues this undermines his free expression rights.<\/span><\/p>\n<p><strong><i>Federal Executive News<\/i><\/strong><\/p>\n<p><span style=\"font-weight:400\">The Department of Education has announced plans to alter Title IX sexual assault guidelines, partially citing concerns that current guidelines sometimes posit <\/span><a href=\"http:\/\/dailybruin.com\/2017\/09\/07\/betsy-devos-announces-plans-to-alter-campus-title-ix-guidelines\/\"><span style=\"font-weight:400\">Title IX against the First Amendment<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Department of Justice filed an <\/span><a href=\"http:\/\/www.cnn.com\/2017\/09\/07\/politics\/justice-department-colorado-cake\/\"><span style=\"font-weight:400\">amicus brief on behalf of the baker in <\/span><i><span style=\"font-weight:400\">Masterpiece Cakeshop<\/span><\/i><\/a><span style=\"font-weight:400\">, the case at the Supreme Court that considers the religious liberty and free speech rights of a baker versus the non-discrimination rights of LGBTQ individuals.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Department of Justice has <\/span><a href=\"https:\/\/www.washingtonpost.com\/local\/public-safety\/government-drops-request-to-bar-facebook-from-alerting-users-to-searches-over-political-communications\/2017\/09\/13\/2253a7ee-9890-11e7-82e4-f1076f6d6152_story.html?utm_term=.6d4c28965a18\"><span style=\"font-weight:400\">set aside their demand that Facebook be prohibited from informing users<\/span><\/a><span style=\"font-weight:400\"> when investigators search their communications.<\/span><\/p>\n<p><strong><i>State Legislative News<\/i><\/strong><\/p>\n<p><span style=\"font-weight:400\">An Illinois lawmaker has introduced a bill that would <\/span><a href=\"http:\/\/www.myjournalcourier.com\/news\/113649\/bill-would-require-protesters-show-their-face\"><span style=\"font-weight:400\">prevent protesters from wearing masks<\/span><\/a><span style=\"font-weight:400\"> when police are present, raising some free expression concerns.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><i><span style=\"font-weight:400\">That\u2019s it for your First Amendment Newsflash Sept. 4-Sept. 17.
