Follow FALR on <\/i><a href=\"https:\/\/twitter.com\/FirstAmendLRev\"><i>Twitter<\/i><\/a><i> and <\/i><a href=\"https:\/\/www.facebook.com\/firstamendmentlawreview\"><i>Facebook<\/i><\/a><i> for regular updates.<\/i><\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" class=\"alignnone size-full wp-image-1385\" src=\"https:\/\/journals.law.unc.edu\/firstamendmentlawreview\/wp-content\/uploads\/sites\/8\/2017\/08\/ten_commandments_monument_in_springer_nm_img_0544.jpg\" alt=\"Ten_Commandments_monument_in_Springer,_NM_IMG_0544\" width=\"2592\" height=\"1944\" \/><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Court News<\/strong><\/em><\/p>\n<p><span style=\"font-weight:400\">The ACLU filed suit on behalf of itself, right-wing provocateur Milo Yiannopoulos, PETA, and Carefem, alleging that the Washington Metropolitan Area Transportation Authority\u2019s (WMATA)<\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2017\/08\/16\/first-amendment-banned-from-d-c-metro-literally\/?utm_term=.6c8c12f75d56\"> <span style=\"font-weight:400\">advertising guideline amendments<\/span><\/a><span style=\"font-weight:400\"> are a violation of the First Amendment on its face and as applied to the plaintiffs, after the plaintiffs\u2019 advertisements were rejected.<\/span><\/p>\n<p><span style=\"font-weight:400\">A<\/span><a href=\"http:\/\/www.huffingtonpost.com\/entry\/feds-seek-visitor-records-website-linked-to-trump-protests_us_59935b66e4b0e789a9476e78\"> <span style=\"font-weight:400\">webhosting company is refusing to comply<\/span><\/a><span style=\"font-weight:400\"> with a Department of Justice search warrant attempting to force the company to provide information about visitors to a website used to help organize protests during President Trump\u2019s inauguration.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal judge ordered the writer of the New York Times editorial on Sarah Palin to<\/span><a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/judge-orders-writer-of-ny-times-palin-editorial-to-testify\/2017\/08\/10\/c4c9ab64-7e09-11e7-b2b1-aeba62854dfa_story.html?utm_term=.9e41beb50904\"> <span style=\"font-weight:400\">testify in a hearing<\/span><\/a><span style=\"font-weight:400\"> concerning the dismissal of Sarah Palin\u2019s defamation lawsuit.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Sixth Circuit will resolve the issue of whether Trump&#8217;s statements during a Louisville campaign rally will be protected by First Amendment speech rights or<\/span><a href=\"http:\/\/www.cnn.com\/2017\/08\/14\/politics\/trump-campaign-rally-lawsuit\/index.html\"> <span style=\"font-weight:400\">whether the statements constitute incitement<\/span><\/a><span style=\"font-weight:400\"> after three victims of attacks at the Louisville rally sued Trump and the assailants for damages.<\/span><\/p>\n<p><span style=\"font-weight:400\">A<\/span><a href=\"https:\/\/www.nytimes.com\/aponline\/2017\/08\/11\/us\/ap-us-ten-commandments-supreme-court.html\"> <span style=\"font-weight:400\">coalition of nearly two dozen states<\/span><\/a><span style=\"font-weight:400\"> filed a brief supporting the city leaders in Bloomfield, New Mexico asking the Supreme Court to hear their appeal of a lower court ruling requiring the city to remove a Ten Commandment display from outside City Hall.<\/span><\/p>\n<p><span style=\"font-weight:400\">The<\/span><a href=\"https:\/\/www.nytimes.com\/aponline\/2017\/08\/11\/us\/ap-us-funeral-protests-lawsuit.html\"> <span style=\"font-weight:400\">Eighth Circuit upheld a Nebraska law<\/span><\/a><span style=\"font-weight:400\"> requiring picketers to remain at least 500 feet from funerals, after a protester sued arguing that the law was selectively enforced.<\/span><\/p>\n<p><span style=\"font-weight:400\">The<\/span><a href=\"https:\/\/www.nytimes.com\/aponline\/2017\/08\/08\/us\/ap-us-aclu-facebook-governor.html\"> <span style=\"font-weight:400\">ACLU filed suit<\/span><\/a><span style=\"font-weight:400\">\u00a0against Maine governor for blocking critics on Facebook and deleting comments.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Other News and Commentary<\/strong><\/em><\/p>\n<p><span style=\"font-weight:400\">White supremacists and Neo-Nazis clashed with counter protesters at a \u201cUnite the Right\u201d rally in Charlottesville Virginia, leading to the death of a counter protester and two police officers. While both sides blamed the other for the violence, the rally attendees and counter protesters also cited<\/span><a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2017\/08\/17\/charlottesville-law-enforcement-failed-protect-first-amendment-rights-robert-shibley-column\/573719001\/\"> <span style=\"font-weight:400\">the lack of police intervention as the cause for the escalation of violence and loss of First Amendment protections.<\/span><\/a><\/p>\n<p><span style=\"font-weight:400\">After the deadly violence in Charlottesville, the<\/span><a href=\"http:\/\/www.cnn.com\/2017\/08\/16\/politics\/aclu-free-speech-white-supremacy\/index.html\"> <span style=\"font-weight:400\">ACLU is also under scrutiny<\/span><\/a><span style=\"font-weight:400\"> for representing the white supremacists in the city\u2019s attempt to revoke the permit to gather in a downtown Charlottesville park to protest the removal of the Robert E. Lee statue. However, the<\/span><a href=\"https:\/\/www.aclu.org\/blog\/free-speech\/equality-justice-and-first-amendment?redirect=blog\/speak-freely\/equality-justice-and-first-amendment\"> <span style=\"font-weight:400\">ACLU stands behind the decision to represent the group in the broader effort to protect the First Amendment.<\/span><\/a><\/p>\n<p><span style=\"font-weight:400\">Michigan State, along with the University of \u00a0Florida, Louisiana State University, and Texas A&amp;M, has denied white nationalist Richard Spencer\u2019s request to speak at the university. The universities&#8217;<\/span><a href=\"http:\/\/college.usatoday.com\/2017\/08\/17\/michigan-state-is-3rd-university-this-week-to-turn-down-richard-spencer-event\/\"> <span style=\"font-weight:400\">statements announcing the denial<\/span><\/a><span style=\"font-weight:400\"> state that the universities support freedom of expression, but cite safety concerns and the university\u2019s obligation to the safety and security of its students and the community.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><i>That\u2019s it for your First Amendment Newsflash August 7-20, 2017.
