Arlene\u2019s Flowers<\/span><\/i><span style=\"font-weight:400\">, the case of the Washington State florist who refused to arrange flowers for a same-sex wedding, citing religious freedom and free expression.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><i>Other Court News<\/i><\/strong><\/p>\n<p>A federal judge has blocked Milwaukee\u2019s permit requirements for <a href=\"https:\/\/apnews.com\/58ca55eb0a00440d872444bde69b8092\">augmented reality games<\/a> while a First Amendment suit on the matter is pending.<\/p>\n<p><span style=\"font-weight:400\">The ACLU of Rhode Island has <\/span><a href=\"http:\/\/www.providencejournal.com\/news\/20170718\/aclu-again-sues-cranston-over-efforts-to-stop-panhandling\"><span style=\"font-weight:400\">sued the City of Cranston<\/span><\/a><span style=\"font-weight:400\">, RI, over the town\u2019s panhandling ordinance, which the ACLU says violates the First Amendment. Meanwhile, Columbus, OH has <\/span><a href=\"http:\/\/www.dispatch.com\/news\/20170717\/columbus-police-stop-enforcing-panhandling-law-after-court-ruling\"><span style=\"font-weight:400\">stopped enforcing its panhandling ordinances<\/span><\/a><span style=\"font-weight:400\"> in order to avoid First Amendment violations.<\/span><\/p>\n<p><span style=\"font-weight:400\">In another panhandling case, the City of Slidell, LA has <\/span><a href=\"http:\/\/louisianarecord.com\/stories\/511147798-city-of-slidell-opts-not-to-challenge-federal-ruling-against-proposed-panhandling-license\"><span style=\"font-weight:400\">decided not to appeal<\/span><\/a><span style=\"font-weight:400\"> a June district court ruling declaring its panhandling ordinance unconstitutional.<\/span><\/p>\n<p><a href=\"https:\/\/www.washingtonpost.com\/business\/technology\/facebook-fighting-court-order-over-law-enforcement-access\/2017\/07\/16\/bb7e1d34-6a5d-11e7-abbc-a53480672286_story.html?utm_term=.8c0036b64fd2\"><span style=\"font-weight:400\">Facebook is arguing in federal court<\/span><\/a><span style=\"font-weight:400\"> against a court order blocking the company from informing users when law enforcement execute search warrants to view their online information.<\/span><\/p>\n<p><span style=\"font-weight:400\">A federal district court <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp-content\/uploads\/sites\/14\/2017\/07\/StopRicardoPacheco.pdf?tid=a_inl\"><span style=\"font-weight:400\">struck down a California town\u2019s sign ordinance<\/span><\/a><span style=\"font-weight:400\">, which allowed special provisions for new businesses and certain holidays, citing <\/span><i><span style=\"font-weight:400\">Town of Gilbert<\/span><\/i><span style=\"font-weight:400\">. Read The Washington Posts\u2019 analysis <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2017\/07\/17\/court-strikes-down-exception-from-sign-code-that-allowed-more-flags-around-certain-holidays\/?utm_term=.c55ffd421ab8\"><span style=\"font-weight:400\">here<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Fourth Circuit, sitting en banc, held that prayers before Rowan County, NC Board of Commissioners meetings were <\/span><a href=\"https:\/\/assets.documentcloud.org\/documents\/3894580\/7-14-17-Lund-v-Rowan-County-Opinion.pdf\"><span style=\"font-weight:400\">unconstitutionally coercive<\/span><\/a><span style=\"font-weight:400\">, reversing the ruling of the three-judge panel and upholding the district court\u2019s opinion. Read WRAL\u2019s analysis <\/span><a href=\"http:\/\/www.wral.com\/appeals-court-board-s-prayer-practice-is-unconstitutional\/16819526\/\"><span style=\"font-weight:400\">here<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight:400\">Two Pennsylvania high school students have <\/span><a href=\"https:\/\/www.thomasmoresociety.org\/wp-content\/uploads\/2017\/07\/Parkland-Complaint-Full-with-exhibits.pdf\"><span style=\"font-weight:400\">sued their school district<\/span><\/a><span style=\"font-weight:400\"> for First Amendment violations after administrators conditioned approval of their proposed pro-life club on the group changing its mission statement and agreeing to abstain from certain activities.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Second Circuit ruled that a Catholic elementary school principal fell into the <\/span><a href=\"http:\/\/s3.amazonaws.com\/becketnewsite\/Fratello-Opinion.pdf\"><span style=\"font-weight:400\">ministerial exception<\/span><\/a><span style=\"font-weight:400\"> in employment discrimination law, although the principal was not clergy. Read the New York Law Journal\u2019s analysis <\/span><a href=\"http:\/\/www.newyorklawjournal.com\/id=1202793099036\/Ministerial-Exception-Applies-to-Catholic-High-School-Principal-2nd-Circuit-Rules?mcode=1202617075062&amp;curindex=0&amp;slreturn=20170620114944\"><span style=\"font-weight:400\">here<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><a href=\"http:\/\/mediad.publicbroadcasting.net\/p\/kcur\/files\/backpage_complaint.pdf?_ga=2.234003166.1535087747.1499782567-1129044251.1485529291\"><span style=\"font-weight:400\">Backpage.com has sued<\/span><\/a><span style=\"font-weight:400\"> the Attorney General of Missouri, alleging that the state\u2019s investigations into the website were <\/span><a href=\"http:\/\/kcur.org\/post\/missouri-ag-hawley-backpage-lawsuit-frivolous-no-first-amendment-right-human-trafficking#stream\/0\"><span style=\"font-weight:400\">meant to censor the website<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A <\/span><a href=\"http:\/\/www.courthousenews.com\/wp-content\/uploads\/2017\/07\/WI-Hunting-Law-COMPLAINT.pdf\"><span style=\"font-weight:400\">suit was filed<\/span><\/a><span style=\"font-weight:400\"> in federal court alleging that Wisconsin\u2019s <\/span><a href=\"https:\/\/docs.legis.wisconsin.gov\/2015\/related\/acts\/346.pdf\"><span style=\"font-weight:400\">hunter harassment law<\/span><\/a><span style=\"font-weight:400\">, which proscribes recording hunters among other activities \u201cintended to impede or obstruct a person who is engaged in lawful hunting, fishing, or trapping,\u201d <\/span><a href=\"https:\/\/www.wpr.org\/federal-lawsuit-challenges-wisconsin-hunter-harassment-law\"><span style=\"font-weight:400\">violates the First Amendment<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">New Mexico Representative Steve Pearce has sued New Mexico\u2019s elections official, alleging that the <\/span><a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/rep-pearce-sues-state-wants-to-use-federal-campaign-fund\/article_a13a3784-6d71-11e7-9df2-d7776f9cab94.html\"><span style=\"font-weight:400\">state\u2019s campaign finance laws<\/span><\/a><span style=\"font-weight:400\"> that prevent him from transferring roughly $1 million from his congressional campaign committee to his campaign for governor violate the First Amendment.<\/span><\/p>\n<p><span style=\"font-weight:400\">In the First Amendment suit of the ExposeDAT blogger whose home was searched after a complaint for criminal defamation was filed, a federal judge ruled against dismissing her First and Fourth Amendment claims against the sheriff who executed the search. The judge also ruled that the sheriff is not entitled to qualified immunity. Read Eugene Volokh\u2019s analysis at the Washington Post <\/span><a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2017\/07\/20\/no-qualified-immunity-in-first-amendment-and-fourth-amendment-lawsuit-against-louisiana-sheriff-in-criminal-libel-case\/?utm_term=.05b01b9b04db\"><span style=\"font-weight:400\">here<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">The Ninth Circuit will decide the Glassdoor.com case, which involves federal investigators\u2019 attempts to seek identifying information of anonymous users of the employment review site, <\/span><a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/07\/judge-glassdoor-reviews-arent-political-so-feds-can-grab-user-identities\/\"><span style=\"font-weight:400\">under seal<\/span><\/a><span style=\"font-weight:400\">.<\/span><\/p>\n<p><span style=\"font-weight:400\">A human rights organization has sued the Kentucky Department of Corrections, alleging that the department\u2019s policy of <\/span><a href=\"https:\/\/www.usnews.com\/news\/best-states\/kentucky\/articles\/2017-07-20\/group-sues-after-books-sent-to-kentucky-prisoners-rejected\"><span style=\"font-weight:400\">rejecting book donations<\/span><\/a><span style=\"font-weight:400\"> for prisons that are not on a pre-approved list violates the First Amendment. <\/span><\/p>\n<p><span style=\"font-weight:400\">A Washington State resident filed suit against the state, alleging its <\/span><a href=\"https:\/\/www.unitedstatescourts.org\/federal\/wawd\/247372\/1-0.html\"><span style=\"font-weight:400\">cyberstalking statute violates the free speech<\/span><\/a><span style=\"font-weight:400\"> guarantee of the First Amendment.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong><i>Federal Legislative News<\/i><\/strong><\/p>\n<p><span style=\"font-weight:400\">\u201cIsrael Anti-Boycott Acts\u201d have been introduced in the House and the Senate. Critics have expressed concerns that, as currently written, <\/span><a href=\"https:\/\/www.boston.com\/news\/politics\/2017\/07\/19\/rep-joe-kennedy-iii-reviewing-controversial-israel-anti-boycott-bill-he-supports-following-aclu-concerns\"><span style=\"font-weight:400\">the bills would make supporting boycotts of Israel a federal crime<\/span><\/a><span style=\"font-weight:400\">, raising First Amendment issues. Some cosponsors, including Rep. Joe Kennedy III, have said the bills are not intended to criminalize expressive activity, and that they will be reviewed.<\/span><\/p>\n<p><span style=\"font-weight:400\">The House rejected a proposal to have the <\/span><a href=\"http:\/\/www.politico.com\/story\/2017\/07\/13\/house-vote-study-of-islam-240537\"><span style=\"font-weight:400\">Pentagon study Islamic beliefs<\/span><\/a><span style=\"font-weight:400\"> that might be used to encourage terrorism.<\/span><\/p>\n<p>&nbsp;<br \/>\n<strong><i>State Legislative News<\/i><\/strong><\/p>\n<p><span style=\"font-weight:400\">Rhode Island became the thirteenth state to pass legislation protecting the rights of student journalists to choose the content of student media.
